Thomas GOODWIN of Wivenhoe, Clerk, 1749. D/ABW 96/2/61

In the Name of God Amen I Thomas Goodwin of the parish of
Wivenhoe in the County of Essex Clerke being in Health of Body and of Sound and Disposing
Mind and memory (Thanks be to Almighty God for the same) Do make this my Last Will
And Testament in manner and form Following (that is to say) First I Give and bequeath
to Ann my Dear and loving Wife All my Household Goods plate Linnen pewter Brass
and all my Live and Dead Stock which I shall be possessed of at the Time of my Decease
On condition That she my said wife do and shall pay within Six Months next after
my decease unto Mrs               Causton Wife of Philip Causton of Wivenhoe aforesaid
Yeoman the sum of thirty pounds of Lawfull money of great Britain But if my said Wife shall
Neglect or refuse to pay the said thirty pounds as aforesaid Then and in that case but not otherwise
I Give All my said Household Goods and Stock unto the said Phillip Causton  Also Whereas
since my Intermarriage with my said Wife I have Discharged a Mortgage for Two Hundred
pounds principal money made by her former Husband the Reverend Mr Allen of his several
Farms in Stock and Rottenden in the said county Which said Estates so in Mortgage were left my
Said wife by her late Husband I Do by this my Will from and immediately after the Decease of
my said Wife, Give unto my kinsman James Sturgeon of Bury Saint Edmunds in the County
of Suffolk Surgeon The said Principal Sum of Two Hundred Pounds and all my right and Title
thereto In Trust Nevertheless and my mind and Desire is that the said James Sturgeon
his Executors or Administrators Do and Shall putt out and place at Interest the said sum of Two
Hundred pounds upon Some Security or Securities to be taken in the name of him or them who shall
So place out the same. And Such Security or Securities to Alter and Change at any Time or times
As He his Executors or Administrators shall think fit And to pay apply and Dispose of the
Interest thereof as the same shall from time to time become due and payable unto my Kinsman
William Goodwin and his Assigns for and During the Term of his natural Life And from and
after the Decease of the said William Goodwin Then that the said James Sturgeon his Executors or
Administrators Do pay apply and Dispose of the Interest of the said Two Hundred pounds
As the same Shall arise and grow Due and Payable unto my Godson Thomas Goodwin the
Son of the said William Goodwin untill He shall attain his Age of twenty one Years for and
Towards his maintenance and education, and when and so Soon as he shall attain his Age of Twenty
One Years I do hereby Will and order the said James Sturgeon his Executors Administrators to
pay the said Two Hundred pounds principal money and all Interest to be then Due for the same
To the said Thomas Goodwin But if He Shall Die before He attains his said Age of Twenty One
Years Then I Direct that the said Two Hundred pounds and all Interest that shall be Due at the
Death of the said Thomas shall go to be paid to the Executors or Administrators of the said Thomas
Goodwin Also I Give and bequeath to Mrs Orvill Daughter of Mrs Causton late Widow of
my predecessor Mr Alston Thirty pounds of Like Lawfull money to be paid within three
Months next after my Decease I Give and bequeath to my said Kinsman William Goodwin all my
Books Also I Give and devise unto my said Wife all my Copyhold Messuage or Tenement
And Lands with the Appurtenances in East Donyland in the said County of Essex and which I have

Surrendered to the Use of my Will and from and after the Decease of my said Wife I Give
And Devise the said Messuage or Tenement and Lands last mentioned unto my said
Kinsman William Goodwin and his Assigns for and During the Term of his natural Life
And from and after his Decease I Give the same premises last mentioned unto my said
Godson Thomas Goodwin and his Heirs forever, Also I Give and bequeath unto the
Said James Sturgeon his Executors and administrators the Hundred pounds now advanced
And Lent to Mr John Bacon on Mortgage of his Estate in Colchester in the County of Essex
Aforesaid Also the One Hundred pounds nin the hands of Mr Firmin.  And Likewise
The Fifty pounds principal money now Advanced and lent to Mr Martin Rittlesdale
on a Mortgage of his Estate in Wivenhoe aforesaid Upon this Special Trust
and Confidence Nevertheless That the said principal Sums of One Hundred pound
Fifty pounds and one hundred pounds may be placed at Interest by the said James Sturgeon
His Executors or Administrators Upon some Security or Securities in manner aforesaid and
That the Interest thereof as the same shall Respictively from time to time become Due and
Payable shall and may be paid unto my said Dear and Loving Wife Ann and her Assigns
for her Life and from and after her Decease to the said William Goodwin and his Assigns
for and During the Term of his natural Life, And after his Decease Then to my said
Godson Thomas Goodwin until he shall attain unto his said Age of Twenty One
Years (for and towards his further maintenance & Education & when & as soon as he shall attain that age)
Then I do hereby Will and order my said Kinsman James Sturgeon his Executors
and administrators to pay the said principal moneys of One Hundred pounds Fifty pounds
and One hundred pounds and all Interest that shall be then Due for the same respectively
into the hands of the said Thomas Goodwin But if He shall Die before his attainment
to the said Age of twenty one Years Then I Direct that the said principlal Sums of One
Hundred pounds Fifty Pounds and One Hundred pounds and all Interest that Shall be then
Due for the same Respectively shall go and be paid to the Executors or Administrators
Of the said Thomas Goodwin Likewise I Give and Devise unto my said Wife for
Likewise I Give and Devise unto my said wife for
her Life All that my Messuage or Tenement and the Lands thereto Adjoining called
Wood howers or otherwise Scituate in Chich Saint Osith in the said County of Essex and
Now in the Occupation of John Maxfield his Asignee or Assigns And from and after
The Decease of my said Wife, I Give and Devise the said premises with their
Appurtenances in Chich Saint Osith aforesaid unto my said Kinsman William Goodwin
And his Assigns for and during the Term of his natural Life and from and after his Decease

I Give the said premises last mentioned unto the said Thomas Goodwin and his
Heirs for Ever, Subject nevertheless and I Do hereby Charge the said last
Mentioned Messuage or Tenement Hereditaments and premises Imediately from
My Decease with the Yearly payment of Fifty Shillings so Long as the World
Shall endure on every Saint Thomas’s Day, to the Minister and Churchwardens
Of Wivenhoe aforesaid for the Time being with power of Distress or entry by such
Minister and Churchwarden Nonpayment of every Such Fifty shillings Upon
This Special Trust and Confidence Nevertheless that Such Ministor and
Churchwardens shall and Do pay, and Equally Divide Yearly on Saint Thomas’s
Day the said Fifty Shillings unto and Amongst Five poor Widows of the parish
of Wivenhoe aforesaid who shall most Constantly attend Divine Service in the
parish Church of Wivenhoe aforesaid and shall not Take Alms And I Will that
every Such Widow Shall Lay out their Part in buying a Gown for their Wearing
Within one Month next after such Distribution on failure of which I Request
That She or they may not Take any Further benifitt by this my Will, The First,
Payment thereof to begin and to be made on St. Thomas’s Day which Shall next happen
After my Decease,  All the Rest and Residue of my Personal Estate
of what nature or kind soever and Wheresoever not herein afore by me Bequeathed
I Give (after payment of my just Debts and Funeral Charges & the Charge of the Probate,
Of this my Will are paid and Satisfyed) unto my said Wife, and the said William
Goodwin
Equally to be Divided Between them part and share alike And
My Will is that it Shall and may be Lawfull to and for the said James Sturgeon
his Executors and Administrators to Deduct and retain to himself and themselves
reasonable Cost and Charges which He and they shall SustainExpend or be putt
unto in or about the Execution of this my Will and the several Trusts hereby in
Him and them Reposed.  And That He the said James Sturgeon his Executors
and Administrators Shall not be Answerable or Accountable for any more
Moneys Than shall actually come to his and their hands Nor for the Loss
Thereof, Unless it be by or through his or their willfull Neglect or Default
And Lastly I Do hereby nominate Constitute and Appoint my

Said Wife and the said William Goodwin sole Executrix and Excutor of this
my Will and revoking all former Wills by me at any Time heretofore made I do
Declare this to be my Last, In Witness whereof I have to this my Last
Will and Testament contained in four Sheets of paper sett my Seal to the
Labell that affixeth them together, and my Hand to the three fo[l]i[o] sheets thereof and
my Hand and Seal to the Last Sheet, This ninth Day of December in the
Year of our Lord One thousand Seven Hundred and Forty Three
