Mary TOWNESEND of Wivenhoe, Widow, 1707. D/ACW 23/198

The last Will & Testament of me Mary Townesend of Wivenhoe in the County
of Essex widdow made this nine & twentieth day of October in the yeare of our
Lord God one thousand seven hundred and six as followeth Impris I give to Jonathan
Howes
my Grandson and to Elizabeth Abbott my Grandaughter and to their heires for ever
equally to be divided between them All that my Messuage or tenement in Wivenhoe aforesaid
now in the occupation of me the said Mary Townesend And if either of them shall happen to dye
without Issue and under his or her age of twenty one yeares then in such case my Will is that
the survivor of them shall hold and enjoy the said house to him or her and his or her heires for
ever Item I give to my said Grandson Jonathan Howes the sume of forty pounds to be paid him
att his age of twenty one yeares and the interest thereof att the rate of four pounds for
one hundred pounds for a yeare in the meane time to be paid to his Guardian towards his
mainetenance Item I give unto my said Grandson Jonathan Howes my best Featherbed and
two Feather Bolsters two of my best pillows my biggest Silver Cupp and two Silver Spoones
marked with F. T. A paire of fine Holland sheets A paire of five pillowbeers a paire
of Lockrem pillow Beers Six Diaper Napkins Three of my best pewter Dishes and the brass
hopper now hanging in my house wherein Inow live Item I give to my said Grandaughter
Elizabeth Abbott the sume of forty pounds to be paid her att her age of Eighteen yeares
or day of Marriage which shall first happen And my will is that the interest thereof
at the rate of four pounds for one hundred pounds for a yeare in the meane time be
paid to her Guardian towards her maintenance Item I give to my said Grandaughter
Elizabeth Abbott my second best Bed Two Feather Bolsters and two of my best Feather
pillows My next best silver Cupp Two silver Spoones marked MT. A paire of Fine Holland
sheets and two fine Holland pillow Beers Six Diaper Napkins a pair of Lockrem Pillowbeers
and three of my next best pewter dishes My least Chest of Drawers and my biggest Kettle
And if the said Elizabeth shall happen to dye without Issue before marriage and under
age of one and twenty yeares then my Will is that Robert Abbott brother of the said
Elizabeth shall have and enjoy the said money and goods soe bequeathed to the said
Elizabeth as aforesaid Item I give unto Joseph Howes my Grandson the sume of forty
pounds to be paid him att his age of twenty one yeares And the interest thereof at the
rate of four pounds for one hundred pounds for a yeare to be paid in the meane time
to his Guardian towards his maintenance Item I give unto Benjamiin Howes ay Grandson
and to his heires my Copyhold house and Land in Little Bentley in the said County of
Essex now in the occupation of John Sallowes And also the sume of Twenty five pounds
of Lawfull English money out of which I will his Fine upon his Admission to the sd premisses
shall be paid as also the Court Fees And the remainder of the said Twenty five pounds

I will shall be paid to my said Grandson Benjamin Howes at his age of one and Twenty
yeares and the interest thereof at the rate of four pounds for one hundred pounds for
one yeare to be paid in the meane time to his Guardian towards his mainetenance And
if any of them the said Jonathan Joseph and Benjamin Howes shall happen to dye before
he or they shall attaine his or their respective ages of Twenty one yeares without
Issue of his or their body or bodyes Lawfully begotten Then my Will and meaneing
is that in such Case the Survivors or surivor of them the said Jonathan Joseph
and Benjamin and his and their respective Executors and Adminor shall have & enjoy
the said severall Sumes of money herein respectively given unto him or them soe dying
as aforesaid equally to be divided between them Item I give unto my Grandson
Robert Abbott the sume of Forty pounds to be paid him att his age of Twenty one
yeares And the interest thereof att the rate of four pounds for one hundred pounds
for a yeare I will shall in the meane time be paid to his Guardian towards his
mainetenance And if the said Robert shall happen to dye before he shall attaine
his said age of twenty one yeares and without Issue of his body lawfully begotten
Then my Will is that Elizabeth Abbott sister of the said Robert shall have and
enjoy the said Legacye of forty pounds bequeathed to the sd Robert as aforesaid
Item & give and bequeath unto Jonathan Howes my son in Law All that my Messuage
and Lands with the apprtences situate lying and being in the parish of Chich St Osith
in the said County of Eskex now in the occupation of Joseph Rich To hold to the said
Jonathan Howes my son in Law for and during the Terme of his naturall life And
imediately from & after his decease then I give and bequeath the sd last mentioned
Messuage & Lands with the apptences unto my grandson the sd Joseph Howes and to
the heires of the sd Joseph forever Item I give and bequeath unto my son in Law
Thomas Abbott and Elizabeth his wife (my daughter All that my Messuage & Lands
with the apprtences situate lying and being in the said Parish of Chith St Osith now in
the occupation of William Seabrooke to hold to them the said Thomas and Elizabeth
for and during the Terme of their naturall lives and the life of the longest liver
of them And after the decease of the survivor of them then to the heires of the
said Elizabeth for ever Item I give to my said Son in Law Jonathan Howes tenn
pounds to be paid him within three Months next after my decease upon Condition that the
said Jonathan shall enter into bond to my Executors of the penalty of fifty pounds

that he the said Jonathan Howes my son in Law shall not make any disturbance or give any
trouble to my Execs in Relation to this my will or any the matters herein contained which Bond
of the said Jonathan shall refuse to enter into Then my Will is that the said Legacy of tenn
pounds herein before devised to him shall be void and goe to my Exors All the rest and
residue of my goods Chattles and personall Estate (after my debts Legacies & Funerall expences
As also the Legacies given and bequeathed in and by the last Will and Testament of Joseph
Townesend
my late husband deceased are paid and satisfied) I give to my Exors hereinafter named
And my Will and mind is that my said Executors shall give good Security by bond to my
supervisor herein also named for the true performance of this my Will and the sure
payment of all my Legacies hereby given to my Grand Children as aforesaid But my Will
and meaning is that if my said Son in Law Jonathan Howes shall within two Months
next after my decease give good security to my supervisor herein after named to his satisfaction
for the true payment and delivery of the severall Legacies herein by me devised to the said
severall Children of my said Son in Law Jonathan Howes and the interest thereof at the
severall times and in such manner as in this my will is directed that then the said
Legacies and monies devised to the said Children of my said son in Law Jonathan Howes
shall be paid and delivered to my son in Law Jonathan Howes within three Months
next after my decease And in such case my Will is that my Executor shall not give any security
to my supervisor for the said Legacies soe devised to the Children of the said Jonathan Howes
And if any difference shall arise between my said Granchildren touching the Legacies to them
hereby given and bequeathed My Will and mind is that such difference shall be settled decided
and determined by mi said Supervisor according as he in his discretion shall thinke fitt (if he
be then living) And if any of them shall refuse to abide by such determination that then
he the or they soe refuseing shall forfeite and loose their respective Legacies or Legacies
hereby devised to him her or them soe refuseing And in such case my Will is that the same
shall be equally divided between such of them as shall abide by such determination of my
said Supervisor or be willing soe to doe And I make my son in Law Thomas Abbott and
my said Daughter Elizabeth his wife Execrs of this my Will and my Friend David Siday
of Great Bromly in the said County of Essex gent supervisor thereof to whom I give two
Guineas for his trouble desireing him to advise and assist my exers in the Execution of this
my will In witness whereof I have to this my last Will and testament contained
in three sheets of paper sett my hand and seale to every sheet and my seale to the
Labell or string wherewith the said Sheets are affixed and have published & declared
the same to be my last Will and Testament the day and yeare aforesaid
