John Bawtree

Deeds are generally written without any puctuation or abbreviations. There is often alternative spelling of some words and using upper case letters which do not always mean the start of a new sentence. Neither are they divided into paragraphs but are continuous lines of writing This can make documents difficult to read or understand.

This post shows the Deed exactly as it was written with no attempt to break it down into paragraphs. Done in this way it shows exactly how the original document is written. Summary

Burrs & Harsoms which stated in the Deed was previously named or known as Cross Keys. Burrs and Harsoms is thought to have been situated in West St. as shown on the 1799 Survey map of Wivenhoe

It included Brewhouse, Outhouses, Yards, Malting Office Gardens and Orchards.

Being part of an Estate called Angiers situated between the Malting Office and Yard. Also including the Meadow called the Anchor Meadow.

This Indenture made the nineteenth day of March in the forty first year of the Reign of our Soverign Lord George

the Third by the Grace of god of the United Kingdom of Great Britain and Ireland King Defender of the Faith and so forth And

in the year of our Lord One thousand Eight hundred and One Between John Bawtree of Colchester in the County of Essex

Esquire of thee one part and Edward Sage of Wivenhoe in the said County Esquire of the other part Witnesseth that the said

John Bawtree for and in Consideration of the sum of five shillings of lawful money of Great Britain to him in hand paid by the

said Edward Sage at or before the sealing and delivery of these Presents the receipt whereof is hereby acknowledged Hath bar

gained and sold and by these Presents Doth bargain and sell unto the said Edward Sage his Executors and Administrators

All that Messuages or Tenement with the Outhouses Yards Gardens Orchards Hereditaments and the Malting Office thereupon

erected and other the Appurtenances whatsoever thereunto belonging formerly called or known by the name of the Cross keys situate

lying and being in Wivenhoe aforesaid and now or late in the Tenure or occupation of the said John Bawtree and his Assigns

And also all those Messuages or Tenements called Burrs and Harsoms or otherwise with the Brewhouse Houses Outhouses

Edifices buildings Yards Gardens Hereditaments and Appurtenances thereunto belonging situate lying and being in Wivenhoe afore

said and now or late also in the Tenure or occupation of the said John Bawtree or his Assigns And also all that Close Piece or

Parcel of Land and Ground with the Rights Hereditaments and Appurtenances thereof being such part of an Estate called Angiers

situate and being in Wivenhoe aforesaid as lieth between the Malting Office and Yard of and belonging to the same Estate in the

occupation of the said John Bawtree and Mrs Ram and the meadow called the Anchor Meadow belonging to the Reverend Nicholas

Corsellis And which said Close Piece or Parcel of Land and Premises was heretofore the Estate of William Bawtree of London

Sailmaker and is now or late was in the occupation of the said John Bawtree or his Assigns And the Reversion and Reversions

Remainder and Remainders Rents Issues and Profits of the said Premises and of every part and parcel thereof with the Appurtenances

To have and to hold the said Messuages or Tenements Close Piece or Parcel of Land and Ground Hereditaments

and all and singular other the Premises herein before mentioned and hereby bargained and sold or intended so to be with

their and every of their Appurtenances unto the said Edward Sage his Executors Administrators and Assigns from the day next

before the day of the date of these Presents for and during and unto the full End and Term of One whole Year from thence next en

suing and fully to be compleat and ended Yielding and Paying therefore at the End of the said Term unto the said John

Bawtree his Heirs or Assigns the Rent of one pepper corn only (if the same shall be demanded) To the intent and pirpose that by

Virtue of these Presents and of the Statute for transferring Uses into Possession the said Edward Sage may be in the actual Possession

of all and singular the Premises above mentioned with the Appurtenances and may thereby be enabled to accept and take a

grant and Release of the Reversion and Inheritance thereof to him and his Heirs To the only proper Use and behoof of the said

Edward Sage his Heirs and Assigns forever and to and for no other Use intent or purpose whatsoever In Witness whereof

the said Parties to these Presents their Hands and Seals have hereunto interchangeably set the day and year first above written

This Indenture made the twentieth day of March in the forty first year of the Reign of our Soverign Lord

of the Sum of Eight hundred Pounds of lawful money of Great Britain to the said John Bawtree in hand well and truly paid by

the said Edward Sage at or before the sealing and delivery of these Presents the receipt whereof he the said John Bawtree doth

hereby acknowledge and thereof and of and from every part thereof doth acquit and release and discharge the said Edward Sage his

Heirs Executors Administrators and Assigns and every of them for ever by these Presents he the said John Bawtree Hath granted

bargained sold aliened remised released and confirmed and by these Presents Doth Grant bargain sell alien remise release and con

form unto the said Edward Sage (in his actual possession and seison now being by Virtue of a Bargain and sale to him

thereof made by the said John Bawtree for the term of one whole year in Consideration of the sum of five shillings by Indenture

bearing date the day next before the day of the date of these Presents and commencing from the day next before the day of the date of the same

Indenture of Bargain and Sale and by force of the Statute made for transferring Uses into Possession and to his Heirs All that

Messuages or Tenement with the Outhouses Yards Gardens Orchards Hereditaments and the Malting Office thereupon erected and

other the Appurtenances whatsoever thereunto belonging formerly called or knownby the name of the Cross Keys situate lying & being in

Wivenhoe aforesaid and now or late in the Tenure or occupation of the said John Bawtree and his Assigns And also all those

Messuages or Tenements called Burrs and Harsoms or otherwise with the Brewhouse Houses Outhouses Edifices buildings yards Gardens

Hereditaments and Appurtenances thereunto belonging situate lying and being in Wivenhoe aforesaid and now or late also

in the Tenure or occupation of the said John Bawtree or his Assigns And also all that Close Piece or Parcel of Land and

ground with the Rights Hereditaments and Appurtenances thereof being such part of an Estate called Angiers situate and

being in Wivenhoe aforesaid as lieth between the Malting Office and Yard of and belonging to the same Estate in the occupation of the

claim and demand whatsoever both at law and in Equity of him the said John Bawtree of in and to the said Premises and

every or any Part or Parcel thereof with the Appurtenances And all Deeds Evidences and Writings relating thereto Together

with true and attested Copies of all such other Deeds Evidences and Writings as relate to or concern the said Premises

or any part thereof jointly with other Lands Tenements or Hereditaments To have and to hold the said Messuages or Tenements

Close Piece or Parcel of Land and Ground Hereditaments and all and singular other the Premises herein before mentioned

and hereby granted released and conveyed or intended so to be and every part and parcel thereof with their Appurtenances

unto the said Edward Sage his Heirs and Assigns To the only proper Use and Behoof of the said Edward

Sage his Heirs and Assigns for ever and to and for no other Use Intent or purpose whatsoever And the said John Bawtree

doth for himself his Heirs Executors and Administrators Covenant Promise grant and agree to and with the said Edward

Sage his Heirs and Assigns by these Presents in manner following that is to say that ( for and notwithstanding any Act Deed Matter

or Thing whatsoever by him the said John Bawtree made done committed executed or wittingly or willingly suffered to the

Contrary ) he the said John Bawtree now at the time of the sealing and delivery of these Presents is lawfully rightfully abso

lutely seised of and in or well and sufficiently intitled unto the said Messuages or Tenements Close Piece or Parcel of Land

Ground Hereditament and Premises before mentioned and hereby released and conveyed or intended so to be and every part

 

 

and parcel thereof with their Appurtenances of a good sure perfect lawful and indefeasible Estate of Inheritance in fee

simple without any manner of Condition Use Trust Power of Revocation Equity of Redemption or Limitation of

any Use or Uses or other Restraint Cause Matter or thing to change defeat Incumber revoke or make void the same. And that (for and

notwithstanding any Act Deed Matter or Thing as aforesaid he the said John Bawtree now hath in himself good right full power and

lawful and absolute Authority to grant release convey and assure the said Messuages or Tenements Close Piece or Parcel of Land and

Ground Hereditaments and Premises before mentioned and hereby released and conveyed or intended so to be and every part and

parcel thereof with their Appurtenances unto the said Edward Sage his Heirs and Assigns in manner and form aforesaid

and according to the true Intent and meaning of these Presents And that it shall and may be lawful to and for the said Edward

Sage his Heirs and Assigns from time to time and at all times hereafter peaceably and quietly to enter into and upon and to

have hold occupy possess and enjoy the said Messuages or Tenements Close Piece or Parcel of Land and General Hereditaments

and Premises with the Appurtenances and to receive and take the Rents Issues and Profits thereof from the date hereof to and for his

and their own Use and Benefit without any the lawful Let Suit Trouble Denial Eviction Ejection Herruption Claim or Demand

whatsoever of or by him the said John Bawtree his Heirs Executors Administrators or Assigns or any of them or of or by any other

Person or Persons lawfully claiming or to claim by from or under or in Trust for them or any of them or by from or under their or any

of their Act Means consent default or Procurement And that free and clear and freely clearly and absolutely acquitted exonerated

and dischsrged or otherwise by the said John Bawtree his Heirs Executors or Administrators well and sufficiently saved

defended kept harmless and indemnified of from and against all and all manner of former and other Gifts Grants Bargains

Sales Leases Mortgages Jointures Doners thirds right and Title of Doner and thirds and especially against the Doner and Third

or other claim of Jane the now Wife of the said John Bawtree Judgements Executions Extents Statutes Recognizances

Uses Trusts Intails Wills and of from and against all other Estates Titles Troubles Charges and Incumbrances whatsoever either

already or hereafter to be had made omitted commited executed done or suffered by the said John Bawtree or by any of his Ancestors

or by any other person or persons under whom he or they claim or derive any Title And also that he the said John Bawtree

and his Heirs And all and every other Person and Persons having or lawfully claiming or that shall or may at any time

or times hereafter have or lawfully claim any Estate Right Title Interest either at Law or in Equity of into or out of the said

Messuages or Tenements Close Piece or Parcel of Land and Ground Hereditament and Premises herein before mentioned and

hereby granted released and conveyed or intended so to be or any of them or any part thereof by from under or in trust for

him or them or any of them shall and will from time to time and at all times hereafter upon every the reasonable Request

and at the proper Costs and Charges in the Law of the said Edward Sage his Heirs or Assigns make do acknowledge levy

suffer and execute or cause and procure to be made done acknowledged levied suffered and executed All and every such

further and other lawful and reasonable Act and Acts Deeds devices Conveyances and Assurances in the Law whatsoever

for the further better more perfect and absolute granting conveying and assuring the said Messuages or Tenements Close

Piece or Parcel of Land Ground Hereditaments and Premises with the Appurtenances unto and to the use of the said

Edward Sage his Heirs or Assigns as by the said Edward Sage his Heirs or Assigns or his or their Counsel learned in the

Law shall be reasonably devised or advised and required So as such further Assurances contain in them no further or other

Warranty or Covenant than against the Person or Persons his or their Heirs who shall make or do the same and so as the Party or

Parties who shall be required to make such further Assurances be not compelled or compellable for making or doing thereof to go or travel

from his or their respective Places of abode In Witness whereof the said Parties to these Presents their hands and Seals have hereunto
