591. Charles BAKER of Wivenhoe, Labourer, 1855. D/ACW 45/4/12

In the Name of God Amen I Charles Baker of
Wivenhoe in the County of Essex, Labourer being weak of Body
But of sound Mind and Memory thanks be to Almighty God for
the same Do make and Ordain this my last Will and Testament
in the following manner and form that is to say that I give and
bequeath unto my Dearly beloved wife Mary Baker all my Copy-
hold Tenements and Estates yards Gardens and Premises in the Parish
of Wivenhoe aforesaid during the term of her Natural Life for and towards
the support of herself and my three Children hereinafter Named
and also Immediately after her Decease I give and bequeath all my
aforesaid Copyhold Tenements and Estates, Yards, Gardens and Premises
in the Parish of Wivenhoe aforesaid unto my three Dearly beloved Children
Namely Mary Baker, Williameaner Baker and Hannah Baker to
be then Immediately sold and the Money or Moneys arising from
such sale or sales to be equally divided among my three Dearly beloved
Children above Named share and share alike and Lastly I do hereby
Constitute Nominate and appoint Benjamin Smith of Wivenhoe aforesaid
Esquire and Benjamin Stacey, of [David Durrell of Wivenhoe, Shop Owner and Edward Ham, Wivenhoe, Baker] the same place Gentleman Executors
to this my last Will and Testament revoking and disannulling any
Will or Wills Testament or Testaments by me heretofore made
In Witness whereof I have hereunto set my hand seal this sixth
day of December in the year of our Lord one thousand Eight
hundred and nineteen

On the 26^th day of March 1855 Administration
with the Will annexed was granted to Hannah the wife of
Henry Sherlock one of the natural and lawful children
and a principal legatee named in the last Will and
Testament of Charles Israel Savage Baker (in the said Will
called Charles Baker only) late of Wivenhoe in the County of
Essex Labourer deceased to administer the Goods Chattels
and Credits of the said deceased according to the tenor
and effect of the said Will she being first sworn duly to
administer the Executors therein named having departed this
life in the lifetime of the said Testator and Mary Baker
the Widow and Devisee for life named in the said Will
having also departed this life without having obtained
administration

In the goods of Charles Israel Savage Baker deceased
The Twenty fourth day of March 1855.
Appeared Personally David Durrell of Wivenhoe in
the County of Essex Sailmaker and Edward Ham of
the same place & Baker and the said David Durrell made
Oath and said that he knew and was personally acquainted
with Charles Israel Savage Baker late of Wivenhoe aforesaid
Labourer who departed this life in or about the month of
December One thousand eight hundred and nineteen and
they severally made oath that they the appearers are
respectively the persons whose names and descriptions are
severally interlined in the last will and Testament of the
said deceased (in the said Will called Charles Baker only)
bearing date the sixth day of December. One thousand eight
hundred and ninteen and now hereunto annexed And
the said David Durrell further made Oath and said that
about three years since and after the death of the Executors
named in the said Will he did at the request and by the
direction of Mary Baker the Widow of the said deceased
(since deceased) obliterate the words Benjamin Smith
Esquire and Benjamin Stacy gentleman and that
thereupon he interlined the words David Durrell of.
Wivenhoe ship owner as they now appear therein. And
the said Edward Ham further made Oath and said
that he did at the same time and by the like request
and direction of the said Mary Baker interline in the
said Will the words Edward Ham Wivenhoe Baker

and they lastly made Oath and deposed (having
first carefully perused the said Will) that the same
is in all other respects in the same plight and condition
as when interlined by them as aforesaid.

In the Goods of Charles Israel Savage Baker decd
The 24th day of March 1855
Appeared personally Hannah the wife of Henry
Shellock and alleged that Charles Israel Savage
Baker late of Wivenhoe in the county of Essex Labourer
departed this life on or about the month
of December one thousand eight hundred and
nineteen having first made his last will and Testament
hearing date the sixth day of December One thousand
eight hundred and nineteen (in which will he is
by mistake called Charles Baker only) and thereof
appointed Benjamin Smith and Benjamin Staccy
Executors who have both since departed this life without
having proved the said Will That Mary Baker
the Widow and relict and a Devisee for life named in the
said Will of the said Testator hath lately departed
this life without having obtained administration with
the will annexed of the personal Estate and effects of
the sd. Testator that she the Appearer is one of the
natural and lawful Children and principal Legatee
named in the Will of the said Testator wherefore she
prayed Administration of the Goods Chattels and Credits
of the said Testator (with his said will annexed) to be
granted to her on giving security for the same.

Know all Men by these presents that We, Henry Shellock of the
parish of Wivenhoe in the County of Essex, Sawyer and
David Durrell of the same place Sailmaker
are held and firmly bound unto The Worshipful John Haggard
Doctor of Laws official in and throughout the whole
Archdeaconry of Colchester lawfully appointed in the sum of
Forty Pounds.
of good and lawful money of Great Britain, to be paid unto the said
Official or to his certain Attorney,
his Executors, Administrators, or Assigns, to which payment, well and truly to be
made, we oblige ourselves, and each and every of us, by himself and themselves
for the whole, our, and each and every of our Heirs, Executors,
and Administrators, firmly by these presents, sealed with our Seals, dated the
Twenty fourth day of March in the
eighteenth year of the Reign of our Sovereign Lady Victoria, by the grace of God,
of the United Kingdom of Great Britain and Ireland Queen, Defender of the
Faith, &c., and in the year of our Lord, One thousand eight hundred and fifty five

The Condition of this Obligation is such that if Hannah the wife of the above
bounden Henry Shellock
named in the last Will and Testament of Charles Israel Savage Baker called
in the Will Charles Baker late of Wivenhoe aforesaid Labourer deceased, and
Administratrix (with the said Will annexed) of the Goods, Chattels, and Credits of the said
deceased, do make or cause to be made a true and perfect Inventory of all and singular the Goods,
Chattels, and Credits of the said deceased, which have, or shall come to have hands, possession, or
knowledge, and the same do exhibit into the Registry of the Archdeaconry Court
of Colchester on or before the last
day of June next ensuing, and the same Goods, Chattels, and Credits do
well and truly administer, (that is to say) do pay the debts which the deceased did owe, at the time
of his death, and then the Legacies, if any, contained in the said Will, so far as the said Goods,
Chattels, and Credits will thereto extend, and the law require. And further, do make or cause to
be made a true and just Account of her Administration, when she shall be lawfully thereunto
required. And all the rest and residue of the said Goods, Chattels, and Credit’s which shall be
found remaining upon his Account, and not otherwise disposed of in the said Will, and allowed
of by the Judge of the said Court, for the time being, shall distribute and dispose of in such manner
and form as shall be limited by the discretion of the said Judge, pursuant to the Act of Parliament
in that behalf made. And lastly, do at all times hereafter, clearly acquit, discharge, and save
harmless the before named official and all Officers of the said Court, against
all persons having, or pretending to have, any right, title, or interest unto the Goods, Chattels, and
Credits of the said deceased.  Then this Obligation to be void and of none effect, or else to remain
in full force and virtue.
