295. John DEAVOURIX Snr of Wivenhoe, Mariner, 1694. D/ACW 22/29

In the name of God Amen I John Deavorix of Wivenhoe in the County of Essex Sen & marriner
being weak in body but of sound & perfect mind & memory praised be God therefore doe make & declare this
my last will & testament in manner & forme following (that is to say) first I bequeath my soul into the hands
of Almighty God my Creator hoping to be saved through the alone merits off my Saviour Jesus Christ And
my body to the Earth to be decently buried according to the discretion of my Executrix hereafter nominated
Item I give & bequeath unto my loving wife Mary Deavorix the sume of Forty pounds out of that
sixty pounds that Jonathan Pod of Wivenhoe marriner owes to me I having a Copyhold messuage surrendred
to me for the pay[me]nt of the said Sixty pounds And one halfe of an Eight part of the Hoy called the
Arundell whereof I under God goeth master to her & her Heires for ever Item I give & beqeath unto my
Son Thomas Deavorix the sume of twenty pounds the remainder of the said Sixty pounds when he comes to
the age of Eighteen years or day of marriage which shall first happen but to have the use of it presently
after my decease and Twenty pounds which William Malster upon Wivenhoe Heath Blacksmith owes to
me for which money I have his house surrendred to me when he shall attaine to the age of Eighteen
years or day of marriage which shall first happen but to have the use presently after my decease but
my will is that the said Forty pounds that I have bequeathed to my said son Thomas be paid by my
Executrix into the hands of Mrs Ann King widow living in Wivenhoe for the use of my said son Thomas
and his Heires for ever presently after my decease Item I give & bequeath unto my said Son Thomas one halfe
of the said Eight part of the said Hoy And my will is that the said Hoy shall be sold presently after my
decease by my Executrix that is to say my Eight part And the one halfe of the money arising therefrom
to be delivered into the hands of the said Ann King for the use of my said son Thomas when he shall
attaine to the age of Eighteen years or day of marriage which shall first happen but to have the use
and profit presently after my decease Item I give & bequeath unto my son John Deavori the sume of
One shilling to be paid presently after my decease And if my son Thomas happen to die under the said
age or without issue then my will is that what I before bequeathed to my son Thomas to come to my Son
John & his Heires for ever presently after the decease of my said son Thomas And if both my said sons
happen to die without Isaac Then to goe to the right Heires of me John Deavorix for ever Item I give &
bequeath unto my said loving wife all my moveables whatsoever except before bequeathed she
paying my Funerall charges and all my debts And lastly I doe make and ordaine my said Loving wife
Mary Deavorix sole Executrix of this my last will revoaking all other wills I doe ordaine this my
last In witness whereof I have to this my last will set my hand & seale this Eight & Twentith day of
July Anno RR Gulielmi et Marie Anglie &c sexto Annoq Dni 1694
