345. Thomas CROSS, Mariner, 1713.  D/ACW 24/135

In the Name of God Amen Thomas Cross of Wivenhoe in the County of Essex Mariner, being thanks be given to Almighty God in good health
& of sound & disposing mind & memory & calling to mind the uncertainty of Life & Certainty of death do make & ordain this my last Will & Testamt in manner following renouncing all Wills
by me formerly made Impris I commit my soul into the hands of Almighty God who gave it hoping through the alone merits of my ever blessed saviour Jesus Christ to inherit eternal life,
And as touching that temporal Estate which God in his Great mercy hath bestowed upon me I dispose thereof as follows Item I give & bequeath unto my son Thomas Cross All that my one fourth
part & also all two & thirtieth part of the Vessell or Hoy Called the Owners Goodwill whereof my self (under God) is at pesent Master together with all my one fourth part & one two & thiertieth
part of all the masts Sayles yards Anchors Cables ropes cords boat Tackle munition Apparell & apteninces to the said vessel or Hoy belonging to hold to my said son Thomas Cross his exetors adtors
& Assigns To his & their own proper use for ever therewith & thereby to use do & dispose of at his & their own free wills & pleasure provided nevertheless & my will further is that my said son Thomas
Cross shall pay thereout unto my Extors herein after named within Twelve months after my decease the sum of ten pounds which said sum of ten pounds I do order shall be for & towards the
payment of my debts & the Legacies herein after bequeathed Item I give & bequeath unto my Son William Cross All that my one sixteenth part of the vessel or Hoy called the delight whereof Henry Collings
(under God) now is or Late was Master together with all my one sixteenth part of all the maste sayles yards Anchors Cable Ropes Cords boat tackle munition Apparel & appteninces to the said Vessell or Hoy
belonging to hold to my said Son William his Extors Adtors & Assigns to his & their own proper use for ever therewith & thereby
bequeath unto my said Son William Cross the sum of fifty seven pounds & ten shillings to be payd by my Extors hereafter named within twelve months next after my decease Item I give & devise
unto my Son Joseph Cross all those my Customary Tenemnts & Lands with the outhouses Edifices thereupon being & thereunto belonging called the Fishhouse or otherwise together with all the ways easemts
& apptennces thereunto belonging now in my own occupaton, holden of the mannor of Wivenhoe in the said County of Essex & all other my messuages Lands Tenements & hereditamts lying &
being in the Parish of Wivenhoe aforesaid to hold to my said Son Joseph Cross his heirs & Assigns forever Item I give & bequeath unto my said son Joseph Cross the sum of twenty pounds
to be payd by my Extors hereafter named within twelve months next after my decease item I give & devise all & singular my one third part of the freehold messuage farm &
Lands with the apptennces situate a being in Steeple cum Stangate Assledon & St Lawrence in the said County or any other adjacent parish now or late in the occupation of Jonathan Truslow or his assigns
& all other my Mesuages Lands Tenemnts hereditamts lying & being in the said Parishes of Steeple cum Stangate Assleden & St. Lawrence or any other parish thereunto
to be sold by my Extors herein after named within Two years – – -after my decease for the best price they can get for the same &
in Fee to any purchaser or purchasers & his her & their heirs & Assigns & the money arising & to be payd for the same by virtue of such sale my will is shall be for & towards the paymt
Just debts & the Legacies herein before & after ordered to be paye by my Extors Item I give & devise all that Copyhold Messuage or Tenemt & farm with the outhouses lands tenemts hereditamets
& apptennces thereunto belonging situate & being in Wigborow Magna Wigborow Parva or one of them in the said County of essex now or late in the occupation of John Moor or his Assigns And all other my Messuages
Lands Tenemts & hereditamts in the said Parishes of Wigborow Magna & Parva unto my six Children Mary the wife of Henry Atkinson William cross John Cross George
Cross & Joseph Cross to hold (after the decease of my sister in Law Hannah Cross) unto my said six Children Mary Thomas William John George & Joseph & their heirs forever as tenants in common
& not Jointenants equally to be divided amongst them part & part alike Item I give & bequeath unto my three children Mary the wife of Henry Atkinson John Cross & George Cross the sum of twenty
pounds apiece to be payd by my Extors hereafter named within Twelve months next after my decease Item I give unto my grandson Thomas Atkinson the sum of five pounds to be payed by my extors
at the time of his being bound Apprentice or age of One & twenty years which shall first happen Item all the rest & residue of my goods Chattells Credits book debts bills Bonds Mortgages plate ready
money & personal Estate what Soever (after my Just debts funeral Expenses & probate of this my will & the Legacies herein before given first payd & discharged I give & bequeath unto my said six
Children Mary the wife of Henry Atkinson Thomas Cross William Cross John Cross George Cross & Joseph Cross equally to be divided amongst them part & part alike And moreover my will is that if it
shall happen that the said Vessells or either of them shall be lost or taken as prize before my decease or before my said sons Thomas or William respectively may or can be be actually possessed of their
parts thereof Then In such Case I give unto my Son Thomas Cross in lieu of the said one fourth part & one two & thirtieth part of the said Vessell called the Owners Goodwill & the apptenences which shall so be lost or
taken as prize as aforesaid the sum of Seventy pounds (to be payd by my extors) & likewise in such Case I give unto my son William Cross in lieu of the said one sixteenth part of the said vessel called the delight & the apptennces which
shall so be lost or taken as prize as aforesaid the sum of twelve pounds ten shillings (to be payd by my extors) if the said Vessell called the owners goodwill shall be lost or taken prize as aforesaid before my decease or before my son
Thomas mayor can be actually possessed of the parts thereof with the apptennces to him herein before given then my will is that my said son Thomas shall not pay the above mentioned sum of ten pounds herein before
ordered to be by him payd to my Extors And my will further is that if my personal Estate shal happen to fall short & not be sufficient to pay the legacies herein before ordered to be payed by my Extors then
each & every of the Legatees afore mentioned shal suffer & bear an equal share in the deficiency thereof in proportion to their several legacies & my extors shal not be obliged to pay more than
according to such proportion & as my personal Estate shal amount unto And I do nominate and appoint my Loving friends John Unthink and Richard Madder to be Extors of this my Will and do give  unto
my said Extors five pounds apiece towards their Care and trouble in the Executing this my Will. And I do declare this to be my last Will & Testamt.  In Witness whereof I have hereunto set my hand and seal the
Seventh day of August in the Eleventh year of the Reigne of our sovreign Lady Anne over Great Britain & Queen Anno Dom 1712
