In The Name of God Amen I Susanna Newton of Wivenhoe in the County
of Essex Widdow being infirme in Body but of sound and Dispossing Mind and understanding
Blessed be God for the Same Do make my Last Will and Testament as Follows (that is to say)
My soul I commend to God and my body to decent Christian Burial at the Discretion
of my Executors herein after named.and as to such Wordly Estate as it hath pleased
God in his Mercy to bestow upon me I Dispose thereof as followeth (that is to say) I give
and bequeath to my sonn Samuell Newton his heirs and assigns all that my copyhold
or Customary Messuage Tenement and Farmehouse With the Outhouses Yards orchards
Lands and appurtenances to the same belonging commonly called or known by the
Name of Tayselford or by whatsoever other Name or Names the same is or hath been
Called or Known now in the Tenure or occupation of Richard Madder or his assignes
Scituate in Wivenhoe aforesaid or in some other parish or parishes thereunto Neare
Or adjoining and holden of the mannor of Wivenhoe by Copy of Court Roll upon
Condition nevertheless that my said sonn Samuel Newton his heires or assigns
shall and do within Twelve Months next after my Decease pay the sume of
One ed and Forty pounds towards paying and discharging the legacys
herein after mentioned which legacys my Will is shall be paid out of the
said sume of One Hundred and Forty pounds and out of my personal Estate
in manner Following (that is to say) I give and Bequeath to my Said Sonn
Samuel Newton the sume of Twenty pounds and to my sonn John Newton
One Guinea To my sonn William Newton Twenty pounds To my sonn Phillipp
Newton Forty pounds To my daughter Margaret Cuffley Twenty pounds to my
Daughter Susanna Loane Tenn pounds To my Daughter Mary Harrington
five and Twenty pounds to my Granddaughter Margaret Cuffley one Guinea
To my granddaughter Susanna Cuffley One Guinea. And my Will is that my Executors
Shall and doe lay out and pay the sume of Tenn pounds towards Binding my
my grandson William Blewitt apprentice to such trade or otherwise as his friends (and my executors)
shall think Fitt And also the like sume of Tenn pounds to be laid out by my executors
in and Towards the Education or putting out of my Granddaughter Susanna
Newton Daughter of my said sonn John Newton in such manner as my executors
shall think fit And I do further give to the said Susanna Newton the sume of Five
pounds to be paid her at her age of one and Twenty Years or Day of Marryage Which
shall first Happen Which Said sume of five pounds my Will is shall in the meane
time lye and remaine in the hands of my said daughter Mary Harrington and
in Case the Said Susanna Newton dyes before the said five pounds becomes payable
then I give the said five pounds to my Daughter Mary Harrington All which
said legacys my Will is shall be paid by my executors to my Said Several Legatees
within Thirteen Calendar Months after my Decease Except the said Legacys given
for the Benefit of the said William Blewitt and Susanna Newton Daughter of my
Said Son John Newton Which I will and order Shall be paid as above is Directed
But in case my Said Son Samuell Newton or his Heirs Shall refuse to accept
of my said Coppyhold Estate Upon the Condition Aforesaid Then I give the Said
Coppyhold Estate to be sold by my Executors or the survivor of them or the Executors
or administrators of such survivor within one year next after my Decease
for the best price that can be gotten for the sameand that the Money Ariseing
by such sale Together with my personal Estate be applied Towards the
payment of the Legacys and Sums above Mentioned Item I give and
Bequeath to my Sonn Phillip Newton the Bedstead Curtaynes Quilt and
Blankets in the Kitchen Chamber He having Already had the Bedd Bolster and
pillowes belonging to the same Item I give to him the said Phillip Newton One
Large Pewter Dish and two small ones Six Pewter Plates one Diaper Table Cloath
six Napkins six Cane Chaires and one small Ovall Table to be Delivered to
him Within Two Months next After my Decease And all the rest of my household
goods I give and bequeath to my said daughter Mary Harrington her executors
and administrators and my Will further is That in Case any part of my
household goods should be seized for or upon presence of a herriott due upon
my Death for the Said Copyhold Estate That Such goods be redeemed by my
Executors and shall remaine to and for the use of the said Mary Harrington
and that the money paid for the Redemption there of be deducted out of the
said One hundred and Forty pounds and out of my personall Estate or
out of the moneys arriseing by the sale of the said Coppyhold Estate in Case my
said sonn Samuel Newton shall refuse to accept the same upon the Condition
above mentioned And my Will is and I doe hereby Order that my Wearing
Apparell and Wearing Linnen shall be Equally Divided between my three
daughters Margaret Cuffley, Susanna Loane and Mary Harrington And my Will
further is that in Case my Estate shall fall short and be not sufficient to pay my
debts my Funerall charges the charge of proving my Will the Charges that my
Executors shall be at in Executing the Same and the Sums of money hereby
ordered to be paid to my said severall Legatees That then such Deficiency shall
be borne by my said sons Samuel Newton, William Newton and Phillip Newton
and by my said Daughters Margaret Cuffley, Susanna Loane and Mary
Harrington by an equal and proportionable Deduction out of their several
and Respective Legacys And if there be any overplus after full payment of my
debts Legacys & funeral charges the charge of proving my Will and other
jurident charges That the Same be equally paid to and Divided Amongst my
said three Sonns Samuel Newton William Newton and Phillip Newton
and my said three daughters Margarett Cuffley, Susanna Loane and Mary Harrington
And I do hereby Revoake all wills by me heretofore made and do declare this to
To be my Last And of this my Will I Do nominate and appoint my said sonn
Samuel Newton and my Said daughter Mary Harrington to be Executors
In Witness whereof I have to this my Last Will and Testament Written on
three sheets of paper sett my hand and seale to each sheet this Fifth day
of May in the year of our Lord One Thousand Seven Hundred Thirty and Three
