575. Charles BENNETT of Wivenhoe, Mariner, 1843. PROB11 1985/94

This is the last Will & Testament
of me Charles Bennett of Wivenhoe in the county of Essex
Mariner whereby I give and bequeath my friends James
Barrell of Dartford in the County of Kent Gentleman & to Thomas 
Harvey and Wivenhoe in the County of Essex Shipbuilder all that my
half share of & in a Schooner called the Hero and also all that my
half share of & in a fishing smack or vessel called the New Union
and also all that my share of and interest in a certain vessel called
the Good Intent in trust that they shall pay all profit and benefit
which may arise and be received by them from each and every one
of their aforesaid shares belonging to me in the said vessels viz The
Hero The New Union The Good Intent as the same shall from time
to time arise and accrue to my dear Wife Sarah Bennett for the term
of her natural life and from and after the decease of my said Wife
Sarah Bennett the Said James Barrell and Thomas Harvey shall
stand possessed of the aforesaid shares in the several vessels above men-
tioned intrust that they shall assign over to each of my children
Charles Harriet and Julia one-third or oportion of my said
shares in the aforesaid vessels so soon as they shall respectably attain

the age of twenty one years and if any of my said children
die before they attain the age of twenty one years and unmarri-
ed then the share or portion of him or her so dying shall be equally
divided between the surviving of my children share and share
alike and I hereby direct that if that any time it shall appear to the
said James Barrell and Thomas Harvey to be for the benefit of my
dear Wife Sarah Bennett and my children Charles Harriet and
Julia they may and are hereby empowered by and with the consent
of my dear Wife Sarah Bennett but not otherwise if she be living
to sell or any of the said shares in the said vessels and to invest the
money arising from such sale or sales in any of the Public Funds
of Great Britain or on mortgage of lands or houses within the
Kingdom of Great Britain to apply the interest as it shall from time
arise and accrue in the same manner and for the same purposes
as I have above directed that the benefit & profit arising from the said
shares in the said Vessels should be by them used and applied and
after the decease of my Wife Sarah Bennett the principal son of
money arising from the sale of all or any of my said shares in the
said vessel shall be assigned over or paid to my children Charles
Harriet and Julia in the way and manner I have above directed
and in case my Wife Sarah Bennett should die before any one or
more of my said children shall have attained the age of twenty one
years then the said James Barrell and Thomas Harvey shall and
are hereby empowered to apply such portion or part of the benefit or
profit arrising out of my several shares in the said vessels or such
portion or part of the interest arising from the monies had & obtain
ed by the sale of such shares and invested as above as may seem
to them to be from time to time fit and necessary for the mainte
nance & education of any such one or more of my said children
as shall not at the time of my Wife’s decease have attained the
age of twenty one years yet so that such some money applied for
such maintenance or education of any one child in any one year
shall not exceed one third part of profit arising from the shares or
one third part of the interest of money arising from the sale of
such shares in any one year I give and bequeath all my house-
hold furniture linen plate and china to my dear Wife Sarah
Bennett and I hereby appoint my friends James Barrell and
Thomas Harvey the Executors of this my last Will and Testa-
ment to which I have set my mark this twenty seventh day of
June in the year of our Lord one thousand eight hundred and
forty three Charles (X) Bennett declared & published to be the
last Will & Testament Charles Bennett by the said Charles
Bennett who set his mark thereunto in the presence of us who
in his presence and in the presence of each other have hereunder
signed our Names this twenty seventh day of June eighteen hun-
dred and forty three John Dobson Rector of Wivenhoe Nathaniel
Harvey 

Proved at London 2nd September 1843 before the Judge by
the oaths of James Barrell and Thomas Harvey the Executors to
whom adm[inistrati]on was granted having being been first sworn to wit the said
James Barrell before the worshipful John Danberry Doctor of Laws
and Surrogate and the said Thomas Harvey by comon duly to adm[iniste]r
