468. John ARTHY of Wivenhoe, Baker, 1765. D/ACW 32/1/24

This is the last will and Testament of me John Arthy of
Wivenhoe in the County of Essex Baker made this Seventh Day of
October in the Year of our Lord one thousand seven hundred and sixty
three as follows (vizt) I give and Devise All that my messuage or
Tenement with the appurtenances in Wivenhoe aforesaid unto Mary my
well beloved wife for and during the Term of her natural Life and
after her death I give and Devise my said messuage or Tenement with
the appurtenances unto Elliot Arthy my son and his heirs for ever
I hereby will order and direct that Mr John Arthy of Isleham in
Cambridgeshire and Mr John King of Colchester in Essex or the Survivor
of them or the Executors or Administrators of such survivor shall as
soon as conveniently may be after my death collect and gather in all my
Money and Debts and Sell and Dispose of my Goods and Chattels and
the money arising (after deducting all reasonable charges and discharging
my Just Debts) I will and Direct shall be placed out on good Land Security
or vested in the Publick funds as soon as conveniently may be after the
same shall be collected together, and the Interest thereof as the same shall become
due and paid I woud have applyed for the maintenance of my said wife
and Education and bringing up of my said child until he shall arrive at the
age of Twenty Two years in such manner and proportion as the said John Arthy and
John King or the Survivor of them or the Executors or Administrators of such
survivor shall judge proper and I give them the said John Arthy and
John King or the survivor of them or the executors or administrators of such
Survivor power to apply such part of the principal money as they may see
proper for the binding my son out apprentice and as soon as my said
son shall arrive at the age of twenty two years I give all the money that
shall arise from my personal Estate & in the Hands of the said John Arthy
and John King or the Survivor of them or the Executors or adtors of such
Survivor unto my said Son upon confidence that he will assist his mother i
she shall be then living and I wou’d have the money paid or Securitys Transferred
unto my said son at that Time and in Case my said son shall dye before
he arrives at twenty two years of age and his mother shall be living I give
the Interest of my personal estate unto her during her life, and after her death

and the death of my son dying as af[oresai]d I give the money imapplied that may
be in the Hands of my Executors unto the children of my father William Arthy in
equal shares I constitute and appoint the said John Arthy & John King Executors of this
my will hereby Revoking all others In Witness whereof I have to this my last will & Testament
contained in one sheet of paper sett my Hand & Seal the day & year above

Signed Sealed Published and Declared by the said John Arthy
the Testator as and for his last will and Testament in the
presence of us who in his presence and in the presence of each
other and at his request have subscribed our Names as
thereunto

This Will was proved on the Thirtieth day of September in the Year of our Lord
One Thousand Seven Hundred and sixty Five Before the Reverend John Milton
Clerk Surrogate &c By the Oath of John Arthy one of the Executors to whom
Administration of all and singular the Goods Chattels and credits of the deceased
was granted and committed on the third day of October next following he being
first sworn duly to Administer Power being reserved of making the like Grant
to John King the other Executor named in the said Will when he shall Apply
for the Same.
