469. Elizabeth DAVISON of Wivenhoe, Widow, 1765. PROB 11/908/372

In the Name of God Amen.
I Elizabeth Davison of Wivenhoe in the County of Essex Widow
being of Sound Mind and understanding do make this my
last Will and Testament in manner folowing (that is to say)
First I give and devise unto my Nephew Samuel Luffe of
Abberton in Essex Malster all that messuage or Tenement
with the appertenances called the Wood Yard together with
the Garden Outhouses and other Edifices thereto belonging
now converted into Warehouses and also All that Wharf
lying at the South End of the said premises called the
Wood Yard all which said premises are situate lying
and being in Wivenhoe aforesaid and holden of the Manor
of Wivenhoe by Copy of Court Roll and surrendered by me to
the use of my Will to hold all the same premises to my
said Nephew Samuel Luffe his Heirs and Asigns for ever
Also I give and devise unto my Neice Sarah Bawtree the
wife of John Bawtree of Elmsted in the said County of
Essex Farmer All that by undivided Moiety or full half
part of and in All those two several Freehold Messuages
or Tenements with the Houses Outhouses Edifices Buildings
Yards Gardens Orchards Ways Waters Hereditaments and
appurtenances thereto belonging situate and being in
Wivenhoe aforsaid in a certain Lane there called Hog
Lane And also all that my undivided Moiety or full half
part of and in All that Freehold Messuage (formerly two
dwellings) with the Yards Gardens Orchards Hereditaments
and appurtenances thereto belonging situate in Wivenhoe
aforesaid and late in the occupation of Mary Bragg
Widow and now in the occupation of my sister Mary
Westerbane Widow to hold all the said Freehold premises
unto my said Neice Sarah Bawtree her Heirs and
assigns for ever Also I give and devise unto my said
Neice Sarah Bawtree All that Barn and Stable together
with the Lands Meadow and Pasture Ground thereto
belonging commonly called by the name of Burrs or by
whatsoever other Name or Names the same is called or
known and formerly were in the occupation of Martin
Turner and now are in my own occupation and holden
of the Manor of Wivenhoe aforesaid by Copy of Court
Roll with their and every of their appertenances and

which I have also Surrendered to the use of my will to hold all
the said last mentioned premises to my said Neice Sarah
Bawetree her Heirs and Assigns for ever Also I give and
bequeath to my said Sister Mary Westerbane Widow the
Sum of Four hundred pounds also I give to my Neice Jane
Luffe of Abberton aforesaid Spinster the sum of three
hundred pounds also I give to my Nephew John Pearson
son of my late sister Sarah Pearson Widow deceased the
sum of Two hundred pounds Also I give to my Servant John
Surry the Sum of Thirty pounds all which said Legacies I
will shall be paid to the several Legatees above mentioned
at the Expiration of Twelve Calendar Months after my
decease also I give to my son in Law Mr Austin Stapley
the sum of Twenty pounds for Mourning Also I give to
Charles Trusler Son of the Reverend Mr John Trustler by
Mary his late wife deceased (late Mary Pearson Spinster)
the sum of Fifty pounds to be paid him by my Executrix
hereafter named without any Interest therefore at his
attainment of the age of Twenty one years but in case
the said Charles Trusler shall happen to dye before he
attains such age then I will that the said sum of Fifty
pounds shall go and be taken as part of the Residue of
my personal Estate and be therewith applied also I
give to my Neices Jane Luffe and Sarah Bawtree all
my Wearing Cloaths and Wearing Linnen equally to be
divided between them also I give to my four Neices Mary
Edwards Widow, Ann the wife of Josiah Wallis of London
Sailmaker, the said Jane Luffe and Sarah Bawtree
all my Plate Gold Watch and Rings equally to be divided
between them or such of them as shall be living at my
Death And as to all the Rest Residue and Remainder
of my Goods Chattels Stock in Trade, ready Moneys
Moneys out at Interest and all other my personal Estate
and Effects of what nature or kind soever and whersoever
(after payment thereout of the Legacies aforesaid my Funeral
Charges, the Charge of the Probate of this my Will and
other incident Expenses) I give and bequeath the same to
my said Neice Sarah Bawtree her Executors Adm[inistrat]ors
and Assigns for her and their own use and Disposal
absolutely and lastly I do hereby make nominate constitute
and appoint my said Neice Sarah Bawtree sole Executrix
of this my last will and hereby revoking all former and
other Will and Wills by me at any time heretofore made
publish and declare this to be my last In witness whereof
I the said Elizabeth Davison have to this my last Will
and Testament contained in two sheets of paper set my
hand and Seal to each sheet and my seal to the label
by which they are affixed together this twentieth day of
September in the year of our Lord one thousand seven
hundred and sixty three.  Eliz Davison.  Signed sealed
published and declared by the said Elizabeth Davison the
Testatrix as and for her last Will and Testament in the

presence of us who in her presence and at her request have
hereunto subscribed our names as Witnesses W: B:  Atkinson

A Codicil to be added to and part of the last Will
and Testament of Elizabeth Davidson of Wivenhoe in the
County of Essex Widow Whereas I the said  Elizabeth Davison
have made a Will in writing bearing date the twentieth day of
September one thousand seven hundred and sixty three
and whereas I the said Elizabeth Davison since the
making of my said Will have been admitted to me and my
Heirs on the Surrender of Thomas Arthy and Dorcas his
Wife to all that Messuage or Tenement and outhouse with
the Yards Gardens Orchards and Malting Office
thereupon lately erected and other the Appurtenances
whatsoever thereunto belonging called or known by the
name of the Cross Keys situate lying and being in
Wivenhoe aforesaid and holden of the Manor of Wivenhoe
by Copy of Court Roll and have also surrendered all my
Messuages Lands Tenements and Hereditaments whatsoever
holden of the said Manor of Wivenhoe to the use of my Will
or Codicil thereto to be annewed Now I the said Elizabeth
Davidson to hereby give and devise the said Messuage
or tenement and Outhouse with the yards Gardens Orchards
and the Malting Office thereupon lately erected and other the
appurtenances whatsoever thereunto belonging called or
known by the Names of the Cross Keys situate in
Wivenhoe aforesaid which I purchased of the said Thomas
Arthy and Dorcas his Wife and holden of the said Manor
of Wivenhoe to my Neice Sarah Bawtree the Wife of John
Bawtree of Elmsted in the said County of Essex Farmer her
Heirs and assigns for ever and I do hereby declare that
my said Will in Writing bearing Date the twentieth day of
September one thousand seven hundred and sixty three
and this Codicil which I will shall be added to and
deemed part thereof do contain my last Will and
Testament In Witness whereof I have to this Codicil set
my hand and Seal this twenty seventh day of April in
the year of our Lord one thousand seven hundred and

Codicil to her last Will and Testament in the presence of
us who subscribed our names in her presence and in the

This Will was proved at London with a Codicil
the twentieth day of May in the year of our lord one thousand
seven hundred and sixty five before the Right Worshipfull
George Hay Doctor of Laws Master Keeper or Commissary of

The Prerogative Court of Canterbury lawfully constituted by the
Oath of Sarah Bawtree (wife of John Bawtree) the sole
Executrix named in the said Will to whom Administration was
granted of all and singular the Goods Chattels and Credits of the
deceased having been first sworn by Commission duly to
administer.
