531. Thomas SIMONS the Younger of Wivenhoe, Carpenter, 1804. D/ACW 37/6/23 

In of the Name of God. Amen. I Thomas Simons the younger of Wivenhoe in
the County of Essex Carpenter being sick and weak of Body but of sound mind
Memory and understanding and calling to mind the uncertainty of this Transitory
Life Do therefore make this my Last will and Testament in manner & form
following (that is to say) First and principally I commend my Soul to
Almighty God who gave it and my body to the Earth to be Decently Interred.
according to the Discretion of my Executrix herein after named and for my Temporal
Estate that I shall be possesed off at my Decease I give and Bequeath in Manner
and form following (that into say) First I will and require that all my Just
Debts and funeral Charges be fully Satisfied and paid, which being done I give and
Bequeath to my loving Wife, Elisabeth Simons all and singular the rest and Residue
of my Estates both Real and personal whatsoever and whatsoever, either in possession
Reversion or Execution to her own absolute use and Behoof, with full power for her
to Sell and Dispose of the same as she shall think proper, But if any part.
thereof shall be remaining at the Decease of my said wife, I give and Bequeath the
same to my loving neice Sarah Hart daughter of John & Sarah Hart of Harwich
in the said County of Essex, And Lastly I do hereby Constitute and appoint my
said loving wife Elizabeth Simons full and sole Executrix of this my last will and
Testament hereby revoking and making void all former Wills made by me or my
order Declaring this only to be my Last Will and Testament. In witness
whereof I have hereunto Set my hand and Seal this Twenty fifth Day of March
in the Seventh year of the Reign of our Sovereign Lord George the Third by the Grace
of God of Great Britain France and Ireland King Defender of the faith and in the
year of our Lord one Thousand seven hundred and sciety seven

in 120L of good and lanful money of Great Britan
to be paid unto the said Archdeacon or to his certain Attorney
his Executors Administrator or Assigns To which payment
well and truly to be made Neoblige ourselves and each
for the whole our and each
of us by henself
of our Heirs Executors and Administrators firmly
by these presents Sealed with our Seale Dated the
thirtieth Day of August in the forty fourth year of the Reign of
our Sovereign Lord George the third by the Grace of God of the United

the natural and lawful
above bounden Sarah Stacey
Niere Devisee and Legstel named in the last Will and Testament of
Thomas Simons late of the parish of Wivenhoe in the County of
Essex carpenter deceased
and Administrat
of all and singular the Grode Chatels and Credits of the said deceased with
his Will annexed Do make of cause to be made a true and perfect.
Inventory of all and singular the Goods Chattels and Credits of the
said deceased which have or shall come to be Hands possession or
Inowledge and the same do exhibit into the registry of the Archdeaume
of Colchester
at or before the last Day of November me and the same Goods Chattels
and Credits do well and truly Administer (that is to say Do
pay the Debts of the said deceased which he did one at his Death and
then the Legacces contained in the said will annexed to the said
Letters of Administration so to his committed as far as his Goods
Chattels and credits will there to extend and the Law charge here
And further do make or cause to be made a true and
just account of her Administration when he shall be thereunto
lawfully required and all the rest and Residue of the said Goods
and Credits which shall be found remaining upon her said
Account and not otherwise disposed of in the said Will annexed
and allowed of by the judge of the said court for the time
being shalllenistrate and dispose in such manner and form
as shall be limited by the Discretion of the said Judge And
Lastly do at all times here after clearly a quit discharge
and save harmless the within named Archdeacon the said
judge and all other Officers of the said Court against all
persons having of pretending to have any Right Title or
interest unto the good Chattels and Credito of the said
Deceased. Then this Obligation to be void and of
mone Effect or else to remain in full force and Virtue.

On which Day Appeared Personally Torah Hachey and allenged that
Thomas Simons the Younger late of the Parish of Hivenhoe in the Count
of Essex Garpenter departed this life on or about the 30th Day of
November last having first duly made and executed his last Will and
Testament in Writing and theroafnominated and appointed his Wife
klizabeth Simons Sole Executrix thereof who died in the life time of the said
Testator that the the Appearer is the Natural and tawful Neice Devisee
and Legatee named in the said Will and one of the next of kin of the said
deceased Wherefore the payed letters of Administration of all and
singular the Goods Chattles and Credit of the said Deceased with his
said Will annexed to be granted and committed to her on first giving
good and sufficient security for the same.
Let Administration with the said Will annexed
passasprayed the sd Sarah Hany beingfirs
sworn to perform the said Will and duly to
Administra the same and also that the
Personal Estate of the said Testator does not to the
best of her knowledge or belief amount to the sum
of Sixty Pounds
