422. Samuel ROBERTS of Wivenhoe, Baker, 1745. PROB 11/741/456

In the Name of God Amen
I Samuel Roberts of Wivenhoe in the County of Essex Baker
being of sound and perfect mind memory and understanding
do make my last Will and Testament in manner following
(that is to say) First I give and devise unto my Daughter Mary
Roberts All that my Copyhold Messuage with the Outhouses
Yards Gardens Orchards Lands and appurtenances whatsoever
thereto belonging scituate in Glemsford in the County of Suffolk
and now in the occupation of my Brother Thomas Roberts to
hold to my said daughter Mary her Heirs and Assigns for ever
Upon this Condition and not otherwise That she my said Daughter
and her Guardians during her Minority do permit and suffer
him my said Brother Thomas Roberts to occupy the said premises
at and under the yearly Rent of thirty two pounds by Quarterly
payments and my Will and desire is that my said Daughter and
her Guardians in her Minority do demise the same to my said
Brother Thomas and his Executors from three years to three years
and not otherwise and that every such Demise shall be valid to
my said brother and his Executors accordingly But that he my

said Brother shall in every such Demise be restrained from selling
or spoiling any Timbers or other trees and from selling any
Wood from off the said premises and likewise from committing any
other Waste or Destruction thereon and from over Croping of any
part of the said Lands other than according to the usual Custom
of the Country unless by the special Consent and agreement of my
said Daughter and her Guardians during her Minority And I do
hereby Give and forgive unto my said Brother all arrears of
Rent due to me to Michaelmas day last he my said Brother
paying and discharging all Taxes Quitt rents and Bills for
Repairs of the said premises to that time Also I give and devise
unto my said Daughter Mary Roberts all that my Copyhold
Messuage or Tenement with the Croft of Land and Orchard and
other the appurtenances in Egreement Street in Glemsford
aforesaid and now in the Occupation of Thomas Watkinson and
Thomas Copsey or their Assigns And also All that my other Copyhold
Messuage or Tenement with the outhouses Lands and other the
appurtenances thereunto belonging in Glemsford aforesaid
formerly the Estate of Ambrose Dister To hold to my said
Daughter Mary Roberts her Heirs and Assigns forever Chargeable
nevertheless and I do hereby charge all and every part and parcell
of my severall Estates before mentioned with the payment of
fifteen pounds a year to my loving wife Margaret Roberts during
her natural life without any deduction whatsoever and by
equal Quarterly payments or otherwise at the discretion of my
Executors providing nevertheless that if my said Wife shall happen
to be now with Child that then such Child shall have an equal
share in my said Estates with my said Daughter Mary
subject to the Annuity and Incumbrance aforesaid and my
mind and Will further is that in case my wife shall
not have any other Child by me and my said Daughter shall
happen to dye in the Life time of my said Wife Then and in that
case I give to my said Wife the yearly Sum or Annuity of Twenty
Pounds clear of all deductions during her Life and the said
Increase of annuity to commence from the death of my said
Daughter And I do hereby further Charge all my said Estates
with the payment thereof in manner aforesaid also I give to
my cousin Sarah Morris Daughter of my Brother Daniel Morris
Five pounds Also I give to Susan Iles Daughter of my Sister Iles
Five pounds  Also I give unto my Nephew John Deane Five
Pounds to be paid them at twelve months after my decease
Also I give to my God daughter Anne Cross Daughter of
William Cross of Wivenhoe aforesaid one Guinea to Buy a
Ring for the remembrance of me Also I give my servant Anne
Clements one Guinea Also I give to my said Wife such part
of my Household Goods as she shall choose sufficient for the
Furnishing of two Rooms  Also I give all that my Messuage or
Tenement with the appurtenances wherein I now dwell in
Wivenhoe aforesaid to be sold by my Executors herein after named
together with my utensils and stock in trade for the best prices that
can be gotten and as soon after my decease as conveniently maybe
and the money arising thereby after payment of Legacies my

Just Debts Funeral Charges and the probate of this my Will I
give together with all other my personal Estate whatsoever
and wheresoever to my said Daughter Mary Roberts to be placed
out at Interest by and at the discretion of my Executors for her
use of benefit And I do hereby Nominate constitute and appoint my
Brother in Law John Deane of Fordham in the saind County
of Essex yeoman and my Cousin Thomas Watkinson of Dedham
in the said County Grocer to be executors of this my Will to
whom I give Five Guineas apiece for Mourning and hereby
Revoking all former Wills and Testaments by me at any time
heretofore made I do declare this to be my last In Witness
whereof I the said Samuel Roberts have hereunto sett my Hand
and Seal and have published and Declared this to be my last
Will and Testament this Thirty first day of May in the year of
Our Lord one Thousand Seven Hundred and Forty four.  Samuel

Samuel Roberts as a for his last Will and Testament in the
presence of us and by us attested in his presence Wye Burwood

This Will was proved at London before the Right
Worshipfull John Bettesworth Doctor  of laws Master Keeper
or Commissary of the Prerogative Court of Canterbury lawfully
constituted the Thirtieth day of August in the year of Our Lord
One Thousand Seven Hundred and Forty five by the oaths of
Thomas Watkinson and John Deane the Executors named
in the said Will to whom Administration was granted of all
and singular the Goods Chattels and Credits of the said deceased
being first sworn by Commission duly to adminster ./.
