498. John CLIFFORD of Wivenhoe, Yeoman, 1782. D/ACW 34/5/25

In the name of God Amen I John Clifford of Wivenhoe in
the County of Essex Yeoman being sick and Weak in Body, but of Sound Mind Memory and
Understanding and calling to mind the Uncertainty of this Transitory Life Do therefore make
this my last Will and Testament in Writing in manner and Form following (that is to say) First
and Principally I commend my Soull to Almighty God and my Body to the Earth to be decently
Buried in Wivenhoe Churchyard near my Late Mothers Remains  I likewise desire that I may be carried
by six of my Neighbours, who are each of them to have Black Gloves and the pall to be supported by six
other Neighbours each of whom I direct to have a Black Silk Flatband and Black Gloves And for my
Temporal Estates that I shall be possessed of at my Decease I Give Devise and Bequeath in manner
Following (that is to say) First I Will, Order and Direct that all my Just Debts, Funeral Charges, the
probate of this will, the Charge of a Head and Foot Stone to my Grave and other Incident Charges
attending the Inventory and appraising my effects be fully satisfied and paid out of my personal
Estate which bein done I Give and Devise to my niece Elizabeth Hinard all and singular that my
Copyhold Farm and Lands with the several appurtenances thereunto belonging where I now live to hold
to the said Elizabeth Hinard her Heirs and assigns for ever subject nevertheless to one annuity or yearly
Rent Charge of Four pounds to be paid by even and equal half yearly payments as the same shall become
due to my niece Hannah Hinard (her sister) her heirs and assigns for ever, and in case of failure or neglect of
payments of the said annuity for forty days after the same shall become due as aforesaid (if the same be
lawfully demanded) I then Direct and order that the said Hannah Hinard have full power and authority
to enter upon any part of the said premises in the name of the whole and the whole to occupy possess and
enjoy until such time as the said annuity and arrears of such annuity and the charges attending such entry
be fully satisfied and paid , And I further Will and Direct that if the said Elizabeth Hinard shall die without
Lawful issue that then and in such case the whole of the said Farm and Lands with the several appurtenances
shall descend to the said Hannah Hinard her heirs and assigns for ever and for my personal estates ready
monies debts due and owing to me , crops and stock whatsoever on the Farm, Household Furniture, Implements
of Husbandry and Effects whatsoever, I direct to be valued and appraised at a reasonable time after my
decease, by two indifferent men not interested in the affairs, and the said Elizabeth Hinard to pay one third
part of the value thereof to my wife Mary Clifford, and one third part of the value thereof to her sister Hannah
Hinard and the residue to be her own And I do hereby appoint my friend Joseph Woods the younger of Wivenhoe aforesaid and George Ham
of Fingringhoe in the said county of Essex together with my wife Mary Clifford joint Executors and Executrix of this
my will hereby setting aside and making void all former Wills by me heretofore made, declaring this only to be
my last Will and Testament In Witness whereof I have hereunto set my hand and seal this twentieth day
of August in the sixteenth year of the Reign of King George the Third and in the year of our Lord 1776

of Wivenhoe and George Ham of the Parish of Fingringhoe Farmer both in the
County of Essex Executor the other Executrix named in the Will
Joseph Woods being dead were sworn to the truth of this Will & to the
due performance thereof before me

The said deceased Effects amount
to the Sum  of one hundred & sixteen pounds

Proved on the Twelfth Day of August in the year of our
Lord one thousand seven hundred and eighty four before the
Reverend John Smythies Clk Surrogate &c by the oaths of Mary
Clifford Widow the Relict and George Ham the surviving Executors
to whom administration &c was granted they being first sworn
duly to administer
