491. Daniel BAYLEY of Wivenhoe, 1780. D/ACW 34/3/24

In the name of God Amen I Daniel Bayley of the parish
of Wivenhoe in the County of Essex being in as Good a state
of health as may be expected from my years but of sound
mind memory and understanding thanks be to God for all his
Mercies but considering the uncertainty of this transitory Life
Do make publish and Declare this my Last Will and testament
in manner and Form Following
First I Commend my Soul into the hands of almighty God that gave it
hoping for pardon and Remission of my sins through the merrits
and mediation of my Blessed Saviour and Redeemer and my
Body to the Ground to be Decently Buried in a Christian Like
manner at the Discretion of my Executors herein after named
in Donyland Church yard and near the Remains of my Family
as Conveniently Can be and as to such worldly goods as it hath
pleased to God to bless me with I Give and Bequeath in manner
Following
Vizt:  I give and bequeath unto unto Sarah Iffe my housekeeper the sum
of Twenty pounds on condition she continues with me and in my
service until my Decease but if she the said Sarah Iffe shod
Quit and Leave my Service before my Departure from this
Transitory world that then I give unto the said Sarah
only ten pounds

I likewise Give and Bequeath unto Mary Marchent who now
Resides with my Good Friend Robt Rowles at East Donyland the
sum of Five pounds both which sums (or Legacys) it is my will
sho:d be paid by my Executors at the Expiration of Six months
of my decease.
I likewise give and Bequeath unto John Simons Junr: now Residing at
the parsonage House at Elmstead Farmer my Green Anthem Book
I Likewise Give and Bequeath unto Joseph Woods of Wivenhoe Farmer
any one of my Singing Books he shall chuse
I likewise Give and Bequeath unto William Simons of Elmstead
Farmer any one other of my Singing Books he shall chuse
And after Just Debts Funeral Charges and the probate of this my
last Will and Restament be by my Executors paid and satisfied
they my Executors having first paid themselves the necessary
Expences that may arrize and accrue from the Discharging
their Duty and trust in the Executing this my Will that then
I give and Bequeath unto my son John Bayley of Brightlingsea
in the said County Essex Surgeon all my Cash that shall
Remain my Executors Reserving the aforement:d Legacies in
their hands till the Expiration of the time aforement:d
But nevertheless the last clause is on this Condition and proviso that
my said Son John Bayley to Deliver into the hands of my

Executors a Just Schedule of all my Debts now Due to
my Creditors at the time of my Executing this my Will and
that he shall permit my Executors Quietly to inspect  into
such schedule and all such debts as shall appear to my
Executors honourable and Just Clear of any Defraud and it is
my Will and Desire then that my Executors Do pay Such Debts
to my Sons Creditors before my Son Receives any Cash
It is Further my will and Desire that my Executors Do Settle my
Sons affairs with my Creditors as soon as possible they can after
my Decease and that then they pay unto my said son the
surplus Cash that may be in their hands after Discharging
as above but not before on any Account Whatsoever
And Further I will and Bequeath unto my Said Son John Bayley
all my household Goods Plate Linnen and other Furniture
as they now stand in my Dwelling House at Wivenhoe
aforesaid (Except as before Excepted) the Furniture and so
forth it is my will and Desire that my Executors shall Give
Posesion to my Said Son Imediately after my Funeral
without Reserve
And lastly I do hereby nominate constitute and appoint my
Good Friends John Simons jun: Farmer who now holds the
farm call’d the Blew Gates at Elmstead aforesaid and

Joseph Woods of Wivenhoe aforesaid in the County of Essex
Executors of this my Last will and testament hereby
Revoking and making void all former wills by
me heretofore made hereby Declaring this to be my Last
will and testament
In Witness whereof I the said Daniel Bayley have hereunto set
my hand and Seal to this my Last Will Containing Four
single sheets this twelth Day of February in the sixteenth
year of the Reign of our Sovereign Lord George the third
by the Grace of God of Great Britain France and
Ireland King Defender of the Faith and so forth and in
the year of our Lord One Thousand Seven hundred and
Seventy Six

The second day of August 1780
John Simons one of the Executors within named
Joseph Wood the other Executor being dead, was
sworn to the Truth of this Will and to the
due performance thereof before me

The Testator died the 14th of the last month
in the parish of Wivenhoe
The effects upwards of £300.

This Will of Daniel Bayley late of the Parish of Wivenhoe in the County of
Essex deceased was proved on the Second Day of August in the Year of our Lord one
Thousand Seven Hundred and Eighty before the Reverend Nathaniel Forster
Doctor Divinity Surrogate &c by the oath of John Simons the Younger one of the Executors to whom administration
of all and singular the Goods Chattels and Credits of the said Deceased was granted
and committed on the fifteenth Day of the said month of August he being first sworn duly to administer Power being
reserved of making the like Grant to Joseph to Joseph Wood the other Executor named in the
said Will when he shall apply for the same.
