In the Name of God amen This Thirteenth Day of June in the Eleventh Year of his Maj[es]t[ies]
Reigne William the Third by the Grace of God King of England Scotland France and Ireland Deffender of the faith
Anno Dom: 1699 John Smith Senr: of Wivenhoe in the County of Essex Marriner being sick and weak
in body but of sound and perfect mind and memory praise be givin to almighty God for the same
and knowing the Incertainity of this Life one Earth, and being desireous to set the things in Order
Do make this my last will and Testam[en]t in manner and form following that is to say first and
principally I Commend my soul to Almighty God my Creator Assuredly Believing that I
Shall Receive full pardon and free Remission of my his owne to be saved by the previous death
and Merrits of my blessed Saviour and Redeemer Christ Jesus and my body to the Earth from
whence it was taken to be decently buried in such decent and Christian manner as to my
Exercutor hereafter named shall be thought meet and Conveniant and as touching such worldly
Estate Goods & Chattles as the Lord in mersy hath sent me my will and meaning is the same
shall be Imployed and bestowed as here after by this my will is Expressed: Item I give and
bequeath unto my youngest daughter Mary Smith: all and singular this my house that
I now live in unto her (& goods with the Appurtenances thereto belonging) [interlined]
and her Heirs for Ever and if my S[ai]d Daughter Mary should Dye without issue Lawfully begotten of her body my will is then this house to be sold and the money thereof: Item my will is that all my other houses and lands and parts of vessells whatsoever shall be sould by my Executor: and after my Debts and Funerall
charges paid the Overpluce thereof I give to be equally Devided between my Four the Children
Namely John: George: Elizabeth, and Susan: Share and share a like: Item I give unto my five children
all my Moveable Goods and plate Brass and pewter to be equally Devided amongst them share and
Share alike, Except that which my Daughter Elizabeth hath had to be accounted as part of her proportion
of the s[ai]d goods; also I give unto my s[ai]d Children all my linnen to be equally Dividing amongst them share
and share alike: and all my Rings I give to be Equally divided amongst my said children share alike Item
I give unto my youngest daughter Mary one Large Silver Spoone: and of this my Last will & Testam[en]t
I make and ordaine my Loving Kinsman Thomas Quixley and my Loving Daught[er] Elizabeth Phillips my
whole & sole Executor & Executrix: Revoaking & make void all other wills by me formerly made
this only to be my Last will & Testam[en]t: In witness whereof the s[ai]d Smith have hereunto sett
his hand & Seale the Day and year first above written the fifteen & sixteen Lines part thereof put out and
the Interlineing above where Done before Signing & Sealing thereof
