586. James GRIDLEY of Wivenhoe, Husbandman, 1851. D/ACW 44/9/14

This is the Last will and Testament of
James Gridley of Wivenhoe in the County of Essex Husbandman
I will and direct that immediately after my decease and interment my
Executors well and truly pay all my just debts funeral and
testamentary charges and expenses from my personal and real
estate if required – I give and devise to my son Henry Gridley
all those my two Copyhold Cottages with all right and interest thereto
belonging situated in the parish of Wivenhoe in the County of Essex
where I now reside subject nevertheless that my wife Mary Ann Gridley
resides in one of them Rent free for the term of her Life and I give
and bequeath to my son Henry Gridley the sum of Twenty Pounds
from my personal monies or real estate if required first and previously
to sharing and dividing the same and I will and bequeath to my
wife Mary Gridley the use of all my Household furniture during
her lifetime at her decease the said Household furniture and effects
to be sold and equally divided between my children Henry James
Edward William and Harriet.  I will and direct that after
my decease my Executors do cause to be soldfor the best price that
may be obtained all those my Copyhold Houses and Land situated
on Crockford Heath in the parish of Ardleigh in the County of Essex
and that the sum of eighty pounds of lawful English money upon
mortgage upon Copyhold premises situated in the parish of Alresford
be called in and received by them also the sum of two hundred pounds
upon mortgage upon premises situated at Wivenhoe Cross be called in
and received by them after the receipt of these monies to be equally
divided amongst my Children, Henry, James, Edward William and
Harriet but as my Eldest son Henry takes the Cottages where I now
reside which I value at one hundred pounds I will and direct
that in sharing these monies that the one hundred pounds the
value of the cottages be considered as one hundred pounds value
received on his part.  And it is my will that after the receiving
these monies that if and provided there is not sufficient to pay
the sum of one hundred and thirty pounds a share the sum
I have paid to John Powell my son in law of the parish of East
Donyland that the said John Powell return to my Executors a
sufficient sum that all my children may share alike And I
will and direct that if any of my children depart this Life previously
to the sharing and disposing of my property I direct and will
that his or her children receive their father or mothers share
equally divided between them – And I do nominate and appoint
Henry Gridley and Edward Gridley my two sons Executors to
this my Will In Witness whereof I have set my hand this
fifteenth day of October one thousand eight hundred and forty four

County of Essex Farmer and Edward
Gridley of Ipswich in the said County
of Suffolk Shipwright the Executors within named
were sworn to the truth of the within Will
And to the true performance thereof and
that to the best of their knowledge and
belief the amount of the value of the goods
chattels and Credits of the deceased is
under the sum of Four hundred and
fifty pounds

The Deceased died the 29th day of April
1851 in the Parish of Wivenhoe.

Proved on the 12th day of May 1851 before the Revd Mesach Seaman
Clk. D. D. Surrog. &c by the oaths of Henry Gridley & Edward Gridley the Sons & exors
to whom Admon &c was granted they being first duly to adminr
The deceased died 29th Apr 1851in Wivenhoe.
