376. Thomas SPURHAM of Wivenhoe, Baker, 1727. D/ACW 26/6/40

In the Name of God amen I Thomas Spurham of Wivenhoe in the County of Essex
Baker being in good health & of sound & disposing mind & memory do make my last Will Testament this Fifth
day of October 1724 in manner following that is to say Imprimis I give & devise all that my messuage or Te
nemt wherein I now live Situate & being in Wivenhoe aforsaid unto my Loving son Thomas Spurham during
the term of his Natural Life & after his decease to such child or Children as he shall leave lawfully begotten of his
body & for want thereof to my Grandaughter Anne Spurham Witheat & her heirs for ever Item I give & bequoath
all & singular my Goods Standing in the best Chamber unto Samuel Wood of Lavenham in the County of Suffolk Gent &
to Thomas Thorn of Wivenhoe aforesd Yeoman In Trust that they do permit my loving Daughter Susan Witheat wife
of Heury Withoat of Lavenham afsresd Collermaker peaceafully & quietly to have & enjoy the same for her own separate use
for & during the term of the natural Life of her & her to husband  Henry Witheat & with which he shal in no  ways intermeddle
& from & immediately after his decease In trust that they immediately deliver such Goods to her the sd Susan Witheat
if she shall him survive to her own proper use & behoof for ever But in Case my Daughter shal depart this Life
before her sd husband then In Trust that they Deliver the sd Goods to my Grandaughter Anne Spurham Witheat
aforesd to her own proper use behoof for ever Item I give & bequeath to my Grandaughter Anne Spurham

the sum of fifty pounds to be raised out of my stock at the time of my decease to be put out by my same
Exters herein atter directed & with such Limitations as shall be after mentioned Item all the rest & residue
of my personal Estate what soever not herein bequeathed & disposed of (after full paymt of my debts Legacies
funeral Charges the probate of this my Will & other necessary contingent Charges I do hereby order & direct
that the same to divided into Two equal parts One part of which I give bequeath to my loving son Thomas
Spurham
his Exters & Admors forever And the other part I give & bequeath unto the sd Samuel Wood &
Thomas Thorne In Trust that they make sale of the same with the utmost speed & for the greatest price
that they can really & bonafide obtain therefore And that they put the mony therefrom arising out at
Interest together with the Fifty pounds above bequeathed to my Grandaughter Anne Spurham

upon such Good land Security as they shall approve of and that the Interest thereof shall
be from time to time as they shall receive the same paid to the seperate use of my Loving Daugh
ter Susan Witheat for & during the term of the Natural Life of her so Husband Henry Witheat and wth
which her so husband shall no ways intermeddle but the receipt of the sd Susan Witheat Shall
be a good & sufficient Discharge for the same (that is to say) for the Interest arising from her
own part & during the term of the Natural Life of her husband & for the Interest arising
from the fifty pounds till my sd Grandaughter shall arrive at the Age of One & twenty years
if she my sd Grandaughter so longs shall live And from & immediately after the death of the
said Henry Witheat in Case the sd Susan Witheat shall him survive & Then In Trust that they
pay both principal & interest of her own part to her the sd Susan Witheat to her own use & Behoof &
to be at her sole & absolute disposal But if it happen that the sd Susan Witheat shall depart this Life
before her said husband Henry Witheat & my decease then In trust that the sd interest be apply’d to
wards the Maintenance of the sd Anne Spurham Witheat untill such Time as the shall arrive
at the Age of One & Twenty years from & immediately after which In trust that the whole
principal mony be paid to her the sd Anne Spurham Witheat together with her own Fifty pounds
to her only sole & proper use & behoof And in case my said Loving Daughter Susan Witheat Shall
depart this Life before the sd Henry Witheat her Husband And if my sd Grandaughter shall dy before
her arrival at the Age of Twenty Ond years and without issue of her body lawfully begotten then & in
either of these cases I give & bequeath the principal mony arrising from the goods and the
fifty pounds aforesd given to my Loving Daughter & my Grandaughter as aforesd to my lov-
ing son Thomas Spurham his Extors and Admors for ever & I do hereby appoint nominate
& constitute my sd Loving Friends Samuel Wood & Thomas Thorne Executors of this my last will
& testament & I do hereby revoke & make void all former & other Wills by me at any time hereto
fore made & do hereby publish & declare this to be my last true will & testament
