In the Name of God Amen
I Elizabeth Cock of Wivenhoe in the County of Essex Widow
being of sound disposing mind and Memory to make my last
Will and Testament in manner following (that is to say) First
I give and devise unto Mary Stebbing my Maid Servant her
Heirs and Assigns for ever All that Tenement with the
Appurtenances wherein Allen Tabor now liveth scituate
lying and being in Wivenhoe aforesaid Also I give to my
Kinswoman Susanna Morris of London the Moiety of the House
where Mary Whitley liveth to her and her Heirs for ever
Also I give and devise untor my Kinswoman Deborah the wife
of Captain John Harvey and to her Heirs are Assigns fo rever
All other my Houses Tenements and Real Estate scituate lying

And being in Wivenhoe aforesaid with all the Yards Gardens
and Appertenances thereto belonging but my Mind and Will
is that she the said Deborah her Heirs or Assigns shall be
admitted to the said Estate and shall permit and suffer
Susanna Marshall Widow to take the Rents and Profits of
Inhabit in and enjoy all that Tenement with the Appurtenances
wherein she now liveth for and during her natural Life
she the said Susannah keeping the same in tenantable
Repair and committing no Waste thereon And my Mind and
Will further is that Matthew Martin Esquire and his Heirs
being Owners and Occupyers of the House which he the said
Mathew now liveth in shall and may have to use and
privilege of my Great Orchard in the same manner as he
now useth and enjoyeth the same he the said Mathew and his
Heirs being Owners and Occupyers as aforesaid paying the same
the Yearly rent or sum of forty shillings unto Mr George
Martin his Brother his Heirs or Assigns which said sum of
forty shillings I do hereby desire and direct shall yearly be
paid and distributed unto and among eight poor Widows of
Wivenhoe aforesaid at and by the Election and Nomination of
the said George Martin his Heirs and Assigns and in case the
said Deborah shall not inhabit in my Dwelling House the
said Mathew Martin to be at Liberty to shut up the Gates
of the Orchard Also my Mind and Will further is and I do
hereby order and direct that the said Deborah her Heirs or
Assigns shall out of the said Estate so devised to her as
aforesaid pay or cause to be paid unto my said Maid
Servant Mary Stebbing the Sum of five pounds within six
Months next after my Decease and also to my Kinswoman
The said Susanna Morris of London the Sum of fifty pounds
within six Months next after my Decease if she the said
Susanna shall be then living but if the said Susanna Morris
shall be then dead then the said sum of fifty pounds to be
paid to Ann Morris her Daughter for her own use and
benefit and I do hereby charge my said Estate with the
payment of the same Sums accordingly Also I give and
bequeath unto the four children being sons of my Kinswoman
Ann Gibson of Colchester the Sum of fifty pounds to be equally
divided between them and I do direct at the same shall
be paid into the hands of their Uncle Mr Daniel Gibson of
London within six months next after my Decease for their
use and Benefit Also I give unto my Cozen Alice the Wife
of John Simpson of Harwich the sum of fifty pounds
and to my cozen John Smith of Harwich the Sum of fifty pounds
and to my cozen Mary Lee of Colchester the Sum of fifty
pounds and to my kinswoman Elizabeth the Daughter of
my cozen Francis of Castle Hedingham the Sum of fifty
pounds and to my kinsman John Barrington of Colchester
the Sum of twenty five pounds of my Cozen Mary the
Wife of William Hall of Wivenhoe the sum of twenty five
pounds and to my Cozen Ambrose Cock of London the sum
of twenty five pounds and to the said Mary Stebbing the

Sum of ten pounds and to the said Susannah Marshall the
Sum of five pounds and to Susan Beale Daughter of Captain
Robert Beale the sum of fifty pounds which said several legacys
my Whim and Will is shall be paid within six Months next after
my Decease Also I give and bequeath to the said John Smith
my share or part in the Codsloop and I do give forgive
and Release unto the said John Smith all such Sum and
Sums of money as he now oweth or shall stand indebted
unto me at the time of my Decease Also I give to the
said Mary Hall or my Silver Coffee Pott also I give unto
Daniel Cock Son of my aforesaid Cozen Ambrose Cock my
largest silver Tankard also I give to my said Maid
Servant Mary Stebbing my Common or every Day Wearing
Apparel and Wearing Linnen Also I give to the said Alice
Simpson the Bed and Furniture of my best chamber Also
I give to the said Mary Stebbing the Bed and Furniture of
the Chamber where I commonly lye Also I do order and
direct that sum of fifty pounds be paid by my Executor
into the hands of the said George Martin within six Months
next after my Decease to be by him disposed of to and for
such good purposes as I shall direct by some Note or
Memorandum thereof by me to be given to him in Writing
under my hand Also I give to the said George Martin the
Sum of ten pounds for his Trouble in executing the Trust hereby
reposed in him All the rest and residue of my Goods Chattels
Estate and Effects whatsoever and wheresoever after payment
of all my just Debts and Funeral Charges and the charges of
proving this my Will my mind and Directions are shall be
divided into two equal parts one Moiety whereof I give and
bequeath to the said Captain John Harvey forever and the
other Moyety thereof my Will is shall be paid and delivered
into the hands and custody of the said Geo: Martin to be by
him settled and disposed of and applyed to and for the sole and
separate use and benefit of Mrs. Susan Beale Wife of the
aforesaid Robert Beale her Executors and Administrators for ever
so that the same may not in any sort be lyable to the Debts
or controll of the said Robert Beale but may be and remain
as a separate provision for the said Susan exclusive of her
Husband and be at her own Disposal notwithstanding her
Coverture And lastly I do nominate and appointment said John
Harvey Sole Executor of this my Will and revoking all others
do declare this to be my last In Witness whereof I have to this
my Will contained in two sheets of paper to each sheet set
my hand and Seal this third Day of August in the year of our
Lord one thousand seven hundred and thirty nine Eliz Cock

This Will was proved at London before the

Worshipfull Andrew Coltee Duraset Doctor of Laws and Surrogate
of the right worshipfull John Bettesworth also Doctor of Laws
Master Keeper or Commissary of the prerogative Court of
Canterbury lawfully  constituted the fourth day of February
in the year of our lord one thousand seven hundred and forty
four by the oath of John Harvey the sole Executor in the said
Will named To whom Admin[istrati]on was granted to of all and
singular the goods and credits of the said Deceased
being first sworn duly to administer  Exd
