507. Edward LUGAR of Wivenhoe, Gentleman, 1786. PROB11/1138

In the name of God Amen
I Edward Lugar of Wivenhoe in the County of
Essex Gentlemen being of sound and disposing mind
memory and understanding (thanks be given to Almighty
God for the same) do make this my last Will and
Testament in manner following (that is to say) First
and Principally I commend my Soul into the hands
of Almighty God my Creator hoping through the
Merits of Jesus Christ my Redeemer to obtain
remission of all my Sins and my Body I commit to the
Earth to be decently buried at the discretion of my
Executor hereinafter named and as to the temporal
Estate wherewith it hath pleased God to bless me I
dispose thereof in the following manner Item I give
and devise unto my grandson Edward Lugar the
eldest Son of my late Son Edward Lugar deceased
all that my undivided Moiety or half part of and in
all that my Capital Messuage or Tenement and
Farm called Badley Hall with the Lands Meadows
Pastures Feedings Woods Rights Members Hereditaments
and Appurtenances thereto belonging or therewith
used Letten occupied or enjoyed as part parcel or
member thereof as the same are situate lying and
being in Ardley otherwise Ardleigh in the said County
of Essex and now in the Tenure or occupation of Ann
Lugar Widow Mother of my said Grandson Edward
Lugar his Assignee or Assigns to hold the said undivided
Moiety or half part of and in the said Messuage or
Tenement Farm Lands Hereditaments and Premises
with their appurtenances unto my said Grandson
Edward Lugar and his heirs in for ever subject nevertheless
And I do hereby expressly charge the said undivided Moiety
or half part of the said Messuage or Tenement Farm
Lands and Premises with the payment of one Annuity
or clear yearly Rent charge of Twenty Pounds a
year unto my Daughter in law Ann Lugar
for and during the term of her natural life to Commence
immediately from an after the expiration of the
present Lease under which the said premises are
now held and also subject to the residence of her my
said daughter in law Anne Lugar in any part of
the said Messuage or Tenement and for so long as she 

my said Daughter in Law shall chuse and think proper
And I also hereby further subject and charge the said
undivided moiety or half part of the said Messuage
or Tenement Farm Lands and Premises with the payment
of The several legacies or Sums of two hundred
pounds apiece of lawful money of Great Britain
which I hereby give and bequeath unto my Granddaughter
Maria Ann Lugar and my Grandson Philip Lugar two
other of the children of my said Son Edward Lugar
deceased such Legacy or sum of two hundred pounds
to my said Granddaughter I will and direct shall be
paid to her within twelve months next after my said
Grandson Edward Lugar or his Heirs shall come to
the possession of the said undivided moiety or half part
of the said Messuage Farms Lands and Premises and
the other said Legacy or Sum of two hundred pounds
to my said Grandson Philip Lugar I will and direct
shall be paid at his attainment of the age of twenty
one years And I do hereby devise? and further subject
and charge the said undivided moiety or half part
of the said Messuage of Tenement Farm Lands
and Premises with the payment of one other Legacy
or Sum of One hundred and fifty pounds which I
hereby give and bequeath unto my Grandson Robert
Lugar one other of the children of my said Son
Edward Lugar deceased and which I will and direct
shall be likewise paid unto my said Grandson Robert
Lugar at his attainment of the age of twenty one
years provided always nevertheless and my Will and
Desire is that in case the set Annuity or yearly Rent
Charge of Twenty pounds herein before given to the
said Ann Lugar my Daughter in Law for Life or any
or either of the said Legacys or Sums of two hundred
pounds apiece to my Grandchildren Maria Ann Lugar
and Philip Lugar and one hundred and fifty pounds to
my said Grandson Robert Lugar or any part or parts
thereof shall be behind and unpaid by the space of
three Calendar Months next after the same and respectively
herein before directed to be paid as aforesaid then and
so often from time to time as it shall so happen it shall
and may be lawful to and for the said Ann Lugar my
Daughter in Law and and her assigns and also to and for
such of my said Grandchildren whose Legacy or 

Legacies Sum or Sums of Money shall be so unpaid as
aforesaid and their or his or her Assigns into and upon all
or any part of my said undivided Moiety or half
part of the said Messuage or Tenement Farm Lands
and Premises so charged with the said annuity and
Legacies aforesaid to enter and distrain and the distress
and Distresses then and there found to detain impound
and keep or otherwise dispose of as in cases of Rent
reserved on a Lease until thereby or therewith or

otherwise it’s said annuity or yearly Rent Charge
and the said several Legacies or Sums of Money
and all arrears thereof (if any) and all costs and
Charges from time to time attending such Distress
or Distresses shall be fully paid And satisfied and
further that in case the aforesaid annuity or
yearly Rent Charge or any or either of the
aforesaid Legacies or Sums of Money or any part
thereof shall be behind an unpaid by the space
of three Kalendar months next after the same
are respectively hereinbefore directed to be paid
as aforesaid Then and so often from time to time
as it shall so happen It shall and may be lawful
to and for my said Daughter in law Anne Lugar
and her Assigns and also to and for such of my said
Grandchildren whose Legacy or Legacies sum or
Sums of Money shall be so unpaid as aforesaid
and their or his or her assigns into and upon
all or any part of my said undivided Moiety or
half part of my said Messuage or Tenement
Farm Lands and Premises charged with the
said Annuity or yearly Rent Charge and Legacys
or Sums of Money as aforesaid to enter and
receive and take the Rents Issues and Profits
there of and of every part and parcel thereof to his her and
their own use until thereby or therewith or
otherwise the said annuity or yearly Rent Charge
and the said several Legacies or Sums of Money
and all arrears thereof respectively then due or
that during such possession shall grow due and
all Costs and Charges attending such entry upon
and Perception of the Rents Issues and Profits
thereof and all Damage to be sustained by the said
Ann Lugar my Daughter in Law or any or either
of my said Grandchildren or their assigns by reason
of the Non Payment thereof shall be fully paid
and satisfied provided also and my will and meaning
further is that if my said Grandson Edward Lugar
and all and every other of my said Grandchildren
shall happen to die under the age of twenty one
years without having lawfull issue of his her or
their Body or Bodies or any or either of them
leaving such issue the same should die before his
her or their attainment of the said age of twenty
one years Then and in such case happening I
give and devise the aforesaid Moiety or half part
of and in the said Messuage or Tenement Farm
Lands and Premises with their appurtenances
unto my said Daughter in law Ann Lugar and her
Assigns for and during the term of her natural life
And from and after her decease I give and devise
the same undivided Moiety or half part of and in 

the said Messuage or Tenement Farm Lands
and premises with the appurtenances unto my
Daughter Ann the Wife of Robert Everard of
Copford in the said County Farmer and my two
Grandchildren William Grubb and Deborah Grubb
and their Heirs equally between them as Tenants
in Common and not as joint Tenants also I give and
bequeath unto my said grandchildren William
Grubb and Deborah Grubb the sum of Eighty pounds
apiece also I give and bequeath unto my Granddaughter
Deborah Lugar who now lives with me the like
sum of Eighty Pounds and also five pounds for
Mourning all which said last mentioned four several
Legacies I will and direct shall be paid out of my
personal Estate and Effects within six Months next
after my decease and if it shall happen that
either of my said Grandchildren William Grubb
and Deborah Grubb shall die before his or her
said Legacy shall become due and payable Then
and in such case I give and bequeath the Legacy
of him or her who shall so happen to die unto
the survivor of such my said Grandchildren to
be paid unto such survivor at the time herein
before directed for the payment of the said last
mentioned Legacies Also I give and bequeath
unto my friend William Harman of Ardleigh
aforesaid Gentleman the Sum of Ten Pounds as
a compensation for the trouble and he may have
as one of my Executors in the Execution of this
my Will and after payment of my just Debts
the aforesaid Legacies my Funeral Expenses
and the charges of proving and attending the
execution of this my Will and other incident
Expenses I give and bequeath all the Rest
Residue and Remainder of my personal Estate
and Effects of what nature or kind soever and
wheresoever unto my aforesaid Daughter in Law
Ann Lugar to and for her own sole use and
benefit and Lastly I do hereby make nominate
constitute and appoint my said Daughter in Law
Ann Lugar and the said William Harman
Executrix and Executor of this my Will and
hereby revoking and making void all former
and other Will and Wills by me at any time
heretofore made I publish and declare this
to be my last Will and Testament In witness
whereof I the said Edward Lugar the Testator
to this my last Will and Testament contained
in four sheets of Paper have to each sheet
set my hand and seal this thirteenth Day of
February in the year of our Lord one thousand
seven hundred and eighty three Edwd Lugar
Signed sealed published and declared by the 

said Testator Edward Lugar as and for his last
Will and Testament in the presence of us who
in his presence and at his request have hereunto
subscribed our names as witnesses Thomas Tunmer,
Peter Conway, Phillip Lay./. 

I the within named Edward Lugar having by my
my within written Will given to William Harman
of Ardleigh in the County of Essex Gentlemen the
Sum of ten Pounds as a compensation for the
trouble he may have as one of my Executors
and having also appointed the said William
Harman Executor with my Daughter in Law
Ann Lugar now I do hereby revoke the said
Bequest of ten pounds so given to the said
William Harman and also the said appointment
of him said William Harman as Executor
aforesaid And I do in his place and stead nominate
and appoint my son in law William Grubb of
Birch in the said County Farmer Executor
with my said daughter in law Anne Lugar
And do hereby give and bequeath to the said
William Grubb my Executor the Sum of Five
Pounds for his trouble And I also give to my
Granddaughter the within named Deborah Lugar
the further Sum of five pounds over and
besides what I have given her by my within
written Will and I do hereby further direct
that if my Personal Estate and Effects shall not
be sufficient (after paying my just Debts and
Funeral Expenses) to pay the several Legacies
given by my said Will and also by this my Codicil
that each Legatee shall bear a proportionable
part of such Deficiency in proportion to his or
their Legacy In Witness whereof I the said
Edward Lugar the Testator to this Codicil
written and the back of the fourth or last sheet
of my said Will have set my hand and seal
this twentieth Day of June in the year of our
Lord one thousand seven hundred and eighty five
The Mark of (X) Edward Lugar Signed sealed
published and declared by the said Testator
Edward Lugar as and for a Codicil to his last
Will in the presence of us Wm Cook, Wm Mason 

This Will was proved at London with a
Codicil the tenth Day of February in the year of
our Lord one thousand seven hundred and eighty
six before the Right Worshipful Peter Calvert
Doctor of Laws, Master Keeper or Commissary of

the prerogative Court Canterbury lawfully
constituted by the oaths of Ann Lugar widow and
William Grubb the Executors named in the said
Codicil to whom Administration of all and singular
the Goods Chattels and Credits of the deceased
was granted they having been first sworn by
Commission duly to administer./.
