573. Reverend James IND of Wivenhoe, Clerk, 1842. PROB 11/1968/124

I James Ind being of sound mind make this
my last will I direct my furniture to be sold and my debts to be paid
and whatever I may be possessed to be disposed of as follows to be placed in the hands of my Father for his life paying five percent interest upon it,
to my two sisters Eliza Francis Willson and Helen Ind in the following
proportions viz three fifths to Mrs Willson and two fifths to Helen
Ind and my and at my Father’s death the money in his hands to go to them
in the same proportions provided always that Mrs Willson shall
only have the interest of her shared to be paid half yearly so long as
her husband Colonel Willson lives after his death she may have the
full disposal of it But in case of her death before that of my Father or her
husband then the money at the death of my father to be made over
to her children in equal proportions as they arrive at the age of
twenty one years the interest in the meantime to be paid to their
Father Colonel Willson I bequeath to my brother Edmund Vipan
Ind 100 volumes of my books to be chosen by himself And I appoint
the said Vipan Ind Executor and Trustee and I bequeath to Helen
Ind any book she may choose and likewise all my silver and
plate Witness my hand this 10th day March 1842 James Ind
signed by the said James Ind the Testator and for his last will
and testament in the presence of us who at his request and in the
presence of each other have hereunto subscribed our names as
witnesses John Turner Charles Parker.  

In the Prerogative Court of Canterbury
In the Goods of the Reverend James Ind Clerk deceased.

Appeared Personally Charles Parker Servant to
Edward Ind of Romford in the County of Essex Esquire and made oath
that he is one of the subscribed witnesses to the last will and testament
of The Reverend James Ind late of Wivenhoe in the County of Essex
Clerk deceased bearing date the 10th day of March 1842 now hereunto
annexed And he further made oath that on the tenth day of March
aforesaid the said Testator duly executed his said will by signing his
name and the foot or end thereof in the presence of this deponent and
of Johns Turner the other subscribed witness thereto both of whom
were present at the same time and this deponent and the said John
Turner thereupon attested and subscribed that the said will in the presence
of the said Testator and of each other – Charles Parker – on the
23rd day of Septr 1842 the said Charles parker was sworn to the
truth of the aforegoing Affidavit Before me S.B. Burnaby Sur
