479. John HOWES of Wivenhoe, Gentleman, 1769. D/ACW 32/5/19

This is the Last Will and Testament of me John Howes of Wivenhoe
in the County of Essex Gentleman being weak in Body but of Sound disposing mind memory &
understanding thanks be to God for the same as follows, I will and order that all my Just
Debts Legacys & Funeral Charges be duly paid and satisfied I give and bequeath unto
my friend John Clay of Alresford in the said County Farmer my blue Plush Coat & Waistcoat
with the Silver Buttons thereon Also I give to my friend John Siday of Bures in the said County
Farmer my large China Hunting Bowl with the figures of the Chase thereon marked and my
Tobacco box and Stopper which said several bequests I will shall be delivered to the said John
Clay
and John Siday within one week after my Decease by my Executors And all the
rest and residue of my Estate both Real and Personal whatsoever & of what
nature or kind so ever the same now is or may consist of at the time of my Decease I give
devise and bequeath the same unto my Loving wife Mary Howes To hold to her the said Mary
Howes
her heirs Executors and admons for ever But upon thy express Condition nevertheless and
my Mind & Will further is that my said wife Mary do and shall pay or cause to be paid out of
the Rents and Profits of my Real Estate unto Mary Carter Spinster daughter of John Carter
of Elmstead Lodge in the said County of Essex Farmer the sum of five pounds a year and every year
during the natural Life of the said Mary Carter to commence immediately from the time of my decease
by half yearly payments & whose receipt from  time to time whether sole or under coverture shall be
a good discharge for the same and in default of Payment within ten days after the said half
yearly Payments shall become due Then my mind and Will is and I do hereby order and direct
that the said Mary Carter & her Assigns shall have full power to enter upon all or any part of
the said Real Estates receive the rents & profits thereof to her own use until she shall
be fully paid and satisfied all such arrears and the charges attending the recovering the same
And lastly I do hereby nominate and appoint my said Wife and William popps of
Wivenhoe aforesaid Twine Spinner Executrix and Executor of this my Will and hereby
revoking and making void all former and other Wills by me made I do declare this to be
my last Will and Testament In Witness Whereof I have hereunto sett my hand and
Seal this twenty second day of August in the year of our Lord one thousand seven hundred
sixty nine

I do hereby Certify That Mary Howes Widow William Popps have sworn
that is the Last Will & Testament of the within named John Howes
Deced and that they will to the best of their Power Perform the same

This Will of John Howes late of the parish of Wivenhoe in the County of Essex deceased was proved on the Eigth day of September in the
year of our Lord One thousand Seven Hundred and Sixty Nine before the Reverend Charles Lind doctor in Divinity Surrogate & by
the Oaths of Mary Howes Widow the Relict of the deceased and William Popps the Executors to whom Administration of all and Singular the
Goods Chattels and Credits of the said deceased was granted and committed on the Ninth day of the said Month of September they being first
Sworn duly to Administer.
