543. James LAYZELL of Wivenhoe, husbandman, 1816. D/ACW 39/6/22

This is the last Will and Testament of me
James Layzell of Wivenhoe in the County of Essex
Husbandman as follows I Give devise and bequeath
unto my esteemed Friend Samuel Wade of Wivenhoe
aforesaid with whom I now live all that my Moiety
or equal half part of All that Allotmont or parcel
of Land situate and being upon Crockerford Heath
in the parish of Ardleigh in the said County of Essex
or near thereto being Copyhold of the Manor of
Michael Hall and all my beneficial share.
right and interest therein and thereto to hold the
same unto him the said Samuel Wade his.
Heirs and Assigns upon Trust nevertheless-
as soon as conveniently may be after my decease
to make Sale and dispose of the same for
the most Money that can be obtained for it And
after payment of my debts and deducting from the
Purchase Money the expences of the Sale, my Funeral
and Testamentary charges, the Expences he may
been at on my account and returning to himself
the Legacy or sum of Ten Pounds which I hereby give
to him I will and direct and I do hereby
give and bequeath all the Surplus Money
arising from such Sale unto my Brother John
and my two Sisters Elizabeth the Wife Joseph
Day of Elmsted and Louisa the wife of
Starling of Boxted equally between them share
And share alike and I do hereby declare
that the receipt of the said Samuel Wade
for all or any part of such purchase Money
shall be a good and sufficient discharge
to the purchaser or purchasers And as to the
rest of my Property personal or otherwise which
I may be possed of or entitled to at the time of my
decease I give the same equally between them my
said Brother and Sister’s Elizabeth and Louisa share
and share a like with the exception of my Watch.
which I give to my little Nephew Joseph Day And
of this my will I nominate and appoint my said
Friend the said Samuel Wade sole
Executor And declaring this to be my true
last will and Testament I have hereunto
sett my mark and seal this Twenty
Fifth day of June in the year of our Lord
one thousand eight hundred and sixteen

within named was sworn to the truth of this
Will, & to the true performance thereof; & that
to the best of his knowledge & belief the account
of the Goods Chattles, & Credits of the said
deceased is under the sum of twenty Pounds.

The Testator died in the Parish of Wivinhoe
on the 19th day of June 1816.

Proved on the twenty first Day of September in
the year of our Lord 1816 before the reverend Richard
Hoblyn Mathew Clerk Surrogate &c by the Oath of Samuel Wade Edward Paine
the sole Executor to whom Admon &c was granted
on the second 12 day of October Sep following they being
first sworn duty to administer-
