359. Jonathan HOWES of Wivenhoe, Butcher, 1721.  D/ACW 25/201

In the Name of God Amen I Jonatham Howes of Wivenhoe in the County of Essex Butcher have
this Eighth Day of May in the Year of our Lord One thousand seven hundred & Nineteen made this my last will & testament in
manner following that is to say First I commend my Soul into the hands of Almighty God hoping thro the merits of Jesus
Christ to obtain eternal Salvacon And my body I comit to the Earth to be decently buried at the Discretion of my Executors
herein after named And as to my wordly Estate I dispose thereof as followeth vizt Imprimis is I give and devise All that my
Copyhold Messuage or Tenement with the appurtences situate & being in Wivenhoe aforesaid which I formerly purchased of William
Norden and late were in the occupation of Henry Collin unto my Son Jonathan Howes his heirs & assigns for ever upon Condicon
that he or they shall pay thereout the sum of Fifty pounds towards the discharge of my debts within Twelve months next
after my decease And upon this further Condicon that the said Jonathan Howes his heirs & Assigns shall permit my son Joseph
Howes to occupy the Slaughter house stables and Hay Chamber adjoining & belonging to the said Messuage so long as the said Joseph
shall think fit provided that the said Joseph shall pay for the same to my said son Jonathan his heirs & assigns the sum of Forty
shillings a Year of lawful Brittish money and shall permit him the said Jonathan his heirs & Assigns to brew and wash in the
said Slaughter house and to have the like liberty of using the same as the said Jonathan now enjoys he & they doing no damage
thereby to the said Joseph Howes Item I give and devise unto my said son Joseph Howes and to his heirs and Assigns
for ever All that my Copyhold Messuage or tenement and Garden lying near East Lane in Wivenhoe aforesaid now in my
own Occupacion And all that piece or parcel of an Orchard formerly belonging to the Brickhouse and now joined to x x x x
orcupied with the Garden of the said Messuage or Tenement Upon Condicon that my said Son Joseph his Howes and also
thereout pay discount or allow the sum of Sixty pounds for which I stand bound to him the said Joseph Howes and also
all the Interest money which shall be due for the same at the time of my Death, in full Discharge of my Bond to the
said Joseph Item I give and devise All that my Freehold messuage or tenement with the Lands and appurtences
thereunto belonging lying and being in the parish of East Donyland and now in the Occupacon of John Webb unto
the said Jonathan Howes and Joseph Howes my sons & to their heirs and Assigns To the Intent that they or the
Survivor of them may make sale thereof so soon as they can conveniently after my Decease for the best price
be gotten for the same And the monies arising by sale thereof I will shall be applyed by them or the survivor of
towards the performance of this my will in payment of my debts or legacies and the mesure profits & until such sale I will shall be assets in their hands  Item I give and bequeath unto my son
Benjamin Howes the sum of Twenty pounds of lawful Brittish money to be paid to him by my Executors within Twelve
months next after my decease Item All the rest and residue of my Estate both real and personal whatsoever and wheresoever
I give devise and bequeath unto the said Jonathan Howes & Joseph howes my Executors herein after named their heirs
Executors and Administrators to be by them or the survivor of them disposed of in manner following vizt First I will that
all my just debts legacies & Funeral Charges shall be thereout satisfied and paid And all the Overplus which shall
remain after the same are fully discharged I will shall be equally divided and paid to and among my said three sons
Jonathan Joseph and Benjamin share and share alike And lastly I do hereby nominate and appoint my said
sons Jonathan Howes & Joseph Howes Executors of this my will and revoaking all former wills by me at any time
heretofore made do ordain this to be my last will and testament In witness whereof I have hereunto set my
hand and seal and have published and declared this to be my last will and testament the Day and Year above said
