I William Todd of Wivenhoe in the County of Essex
Gentleman being in ill health of body but of sound and
disposing mind memory and understanding thanks to be to Almighty
God for the same Do make my last will and Testament in manner
Following First I give and devise unto my Niece ElIiabeth Barker the
Wife of Thomas Parker of Elmstead in Essex Husbandman All that
freehold Cottage or Tenement with the Outbuildings Yard and Garden to
the same belonging situate in Elmstead aforesaid and now in the occupation
of the said Thomas Barker or his Assigns And also the Pightle or piece of
Land in which the said Cottage or Tenement stands being part of the
premises formerly belonging to Mr lay to hold the same unto the said
Elizabeth Barker and her assigns for and during her natural life and
after her decease I give the same unto such person or persons and in
such parts shares and proportions and for such estate and interest estates and
interests as she the said Elizabeth Parker notwithstanding her present or any
future coverture shall by any deed or deeds under her hand attested by two or
more witnesses or by her last will and Testament in writing or any
writing in the nature thereof or any Codicil thereto attested by three
witnesses shall direct or appoint And in default of any such direction
or appointment Then to her own right Heirs for ever And I give
and devise unto my Executrix and Executor hereinafter named and their
Heirs All that my other Pightle in Elmstead aforesaid being the remainder
of the premises late Mr Lays upon trust to sell and dispose thereof by public
auction or private contract as they may think fit but for the most money
that can be obtained for the same And the monies thereby arising I desire
shall be added to and applied and disposed of as part of my personal Estate
and the receipt of my Executrix and Executor or such of them as shall act
under this my will shall be an effectual discharge to the purchaser or
purchasers for his her or their purchase money And I give and
devise unto my dear wife Mary Todd and her Assigns for and during her
natural life All those my freehold messuages or Tenements with the
Appurtenances situate in Wivenhoe aforesaid next or near the Road leading
from Wivenhoe Church towards Wivenhoe Hall which premises I
formerly purchased of the late Edward Sage Esquire and are now in
the occupation of myself Thomas Jaggard

Joseph Chiswick Sarah Bacon and the Widow Harvey some or one
0f them their some or one of their undertenants or assigns And I
give and devise unto my Brother Joseph Todd for and during his
natural life All those my freehold messuages or Tenements and
premises in Wivenhoe aforesaid (called the Sun premises)which I formerly purchased of the late
Mr. John Bawtee and all the Erections and building since made by me
thereon which premises are now in the occupation of Thomas Harvey
John Hynard William Powell George Lawrence Thomas Ham
Pretty and the Widow Marshall some or one of them their some or
one of their undertenants or asigns and from and after the decease of
other of them my said wife Mary Todd and Brother Joseph Todd Then
I give and advise the said messuages or Tenements and premises desired
to him or her so dying unto the survivor of them for and during his or
her natural life But my will and desire is that the premises so given
to my said wife and Brother respectively shall be by them at all times
during their respective lives kept in good tenantable repair And from
and immediately after the decease of the Survivor of them my said Wife
and Brother Joseph Iodd I give and advise all and every the several
messuages or Tenements hereditaments and other the premises with the
appurtenances, so to them respectively devised for the lives of them and
the survivor of them as aforesaid, unto Thomas Harvey of Wivenhoe
aforesaid Carpenter and Thomas Sanford of the same place Oyster Merchant
and their Heirs upon trust that they or thensurworf them or the
Executors or administrators of such Janvivor Do and shall as soon as
conveniently may be after the decease of the Janvivor of them my said wife
and Brother absolutely sell and dispose thereof by public auction or
private contract and together or in parcels as they may think fit but
for the most money that can be obtained for the same And the monies
to arise and be produced by such Sale or Sale after payment of all Cost
Bery Berton Charges and Expences attending the same I give and bequeath unto
the children of my late Brother Robert Todd (except the aforesaid Elizabeth
Barker) and Abraham Maskell and Elizabeth Leveress the two Children
of my late Author Susan Muskell part and share a like and to be
vested interests at my decease in all such Children as shall then have
attained the age of twenty one years and in the other or others of such
Children when and as they attain that age and in case of the death of
any such Children under the age of twenty one years I give the share
of him or her so dying unto the survivors And I declare that the receipt
and receipts of the said Thomas Harvey and Thomas Sanford or the
Survivor or such of them as shall act in the trust of my said Will, his
Executors or Administators shall be a good and sufficient discharge and
good and sufficient discharges to the purchaser or purchasers of my said
premises so directed to be sold as last aforesaid for his her and their
purchase money and that such purchaser and purchasers shall not be
bound to see to the application thereof or any part thereof And I
give and bequeath unto my said wife the use and enjoyment of all
my Household Goods plate Linen and Furniture for and during her
natural life and at her decease I will that the same shall be sold andF
the proceeds divided between the Children of my late Brother Robert and
Sister Susan (except the said Elizabeth Baher) in manner aforesaid
And all the reside of my personal Estate, after payment of all
my just debts, my funeral Expences and the charges of præving and execution
this my will I give unto my said dear wife for her own use and benefit
absolutely and I hereby constitute and appoint my said Wife Mary
Todd and my Brother Joseph Todd Ecutrix and Executor of
this my will, and hereby rev Ging all other wills by me heretofore
made I declare this to be my last In witness whereof I have
to this my said will contained in three Sheets of paper set my hand
to the two first sheets, my hard and seal to this third and last
Sheet and my seal to the label by which they are affixed this
first – day of August in the year of our Lord one thousand
right hundred and thirty three./.

Widow and Relict of the within named William
Todd and Joseph Todd of Ehmstead in the
said County Ycomen the executrix and Executor
afithin named were swom to the truth of the
within Will and to the true performance thereof
and that to the best of this knowledge and belief
the amount of the value of the Goods Chattels
and Credit of the deceased is under the Sum of
Two hundred pounds
